Right we moved into our home 3 years ago, we paid 1 months rent as a deposit, and another months rent in advance. We are now moving into a new home and because we are paid in advance we should not have to pay this months rent. I said this to the landlord he said we have not paid a months rent in advance, I said we did he argued we didn't. I then found the receipt from the estate agent which showed we did pay a month in advance. I told the landlord this, he is now argueing that he then gave us a month off at some point which he didn't.

What can we do? He is out to scam us for a months rent. If I don't pay this months rent he will keep the deposit, if I do pay he could keep the deposit to and scam us again??

Hopefully you have receipts to prove you didn't get a months free rent. If you have every months rental receipt i would keep them and show them to your landlord to prove you have paid every month. If you do end up in court, you have this documentation to back yourself up with. Good Luck, I would recommend finding an attorney because you are right, he will probably end up screwing you out of your deposit.

You need to get up all your receipts that you have to prove that you did not get one months rent free. If you don't have the receipts, then cancelled checks for each transaction would be good enough. And from the sound if it, he plans on keeping the deposit anyways.

If you have all the receipts and can prove your case take the landlord to the small claims court for your money. https://www.moneyclaim.gov.uk/csmco2/index.jsp It doesn't cost much and costs can be claimed back from too so you don't lose out.

I agree with above, get a lawyer because he is out to get you. He's just angry because you have rented so long and are now leaving him. My landlord was the same way, but what I did was just cut my losses because it was only $500, which I know is a lot, but it was worth it to just be done with him.

You paid 1 month as a deposit and paid for the first months rent to move in. You dont get any money back for rent. All you would get is the deposit back IF your last months rent was paid and there are no damages. You are not paid in advance. You paid for the month you moved in. So by Aug 1, you should have paid for Aug rent to live there.

If your landlord didn't give you back the deposit, bring him to "Small Claim Court". You will need to bring all the proofs to the court. He will lose the case bc he has no proof that you had a month off. He may deduct your deposits but he will need to provide all receipts for the deduction to the judge. You are more likely to get most of it back.

since you have receipts you should be OK, but be careful if the landlord tries to sue you or keep the security deposit you will need to defend yourself,

most likely after you move out, the landlord will try to keep the security deposit

if the landlord moves for eviction for non-payment of rent, better answer the complaint, show up present your evidence

i would ask him for the proof of the recipet of the free month that you supposedly got and if so which month this is, since u went back and got your recipt from your records than its up to him to do the same for y ou. if he doesnt return ur securoty stay an extra month free! or take him to court and sue for security damage, if they withhold security ur entitled to 3xs that amount back.

He needs to prove he gave you a month off. Get the letting agents involved and if he dont pay up threaten him with a small claims court

In my experience when they ask for "the last month's rent" up-front, it's not meant to actually BE the last month's rent. It's part of your deposit, to be used if you skip out on the last month's rent. So naturally they would still penalize you if they have to use it, like overdraft fees on a checking account. I'm sure it can vary with each landlord/realtor/property management co, but that's just my interpretation of it. If you pay rent in cash, and didn't get receipts I'm not sure what you can do about this. If you paid by check, you can always ask your bank for copies of the canceled checks. This would be to prove that you didn't get a month off during your tenancy. Otherwise I hope you get the "last month" back in your deposit refund. Good Luck.

You paid 1 months rent as deposit, which would be held as a bond to ensure there are no damages to the property when you move out. If there are no damages, this should be returned to you.

With regard to the month in advance. Let's say you move in on 1st Jan - you pay this month in advance which takes you to 1st Feb when the next payment is due. Obviously you have to give notice to vacate, probably one month, so you vacate on 1st Feb which is when you are paid up until. You dont get that money back - you're not leaving until that date.

The money coming back to you should be the deposit monies.

you r not clear wheather you were paying the rent by cheque or cash if it was paid by ch. then u should get the bank statement if in cash then only thing u can do is look into ur books of accounts and if u dont have that too then do whatever he is asking.

ive had a very similar thing happen to me... the best thing you can do is go to the citizens advice beureau... they are fab with helping out with this sort of thing and can advice you and work on your behalf..take all documentation with you and also if youve been paying the rent through your bank account by way of standing order then you can prove youve kept payments up to date... he is so trying to do you over i personally wouldnt pay him this months rent get down the c.a.b get their advice and tell the landlord your intentions... best of luck hun x
