Shamud | Rent due on 1st and late by 10th but landlord harasses after the 2nd.? |
My rent is due on the 1st and is considered late on the 10th of the month. This month, the 1st was Saturday. I don't mail a check - I write a check and deposit it directly to their bank account in person to save my landlord time. I deposited the check on Monday the 3rd, and I have already received an email from my landlord complaining that the rent is due and giving me this lecture about how important it is for them to receive rent on time. I cannot open banks on Saturday, and I certainly won't pay before the 1st. I get paid on the 1st.
How can I politely tell my landlord to give me a break? It's late on the 10th and I can't open the banks on a weekend, and I'm doing them a favor by depositing it for them?
Don't tell me to move, trust me, I would if I could. Additional Details If I mail them a check on the 1st, it will arrive on the 3rd and they will certainly consider it late though. I'd have to post-date it if I sent it early (before the 1st) and I think that might be illegal to post-date a check isn't it ? They live in another state so it would take up to 3 days to arrive for them. |

Honestly, polite and stern will be the way to go on this one. Let your landlord know that you are aware that rent is due before the 10th and out of ease and convenience to them you directly deposit the check into their account on the next available business day. If this is not acceptable you will be happy to mail out your check on the first. Thank them for the reminder but assure them it is not needed.
In doing this you will not only tell your landlord to back off by stating that the reminder isn't needed. You will be politely threatening to delay the check by mailing it instead of depositing it. Your landlord should back down realizing that they will not have a leg to stand on, even if you mail the check later delaying the time it takes them to get their money.
Keep your e-mails as well. Once you have respectfully asked them to not send you reminders, you can keep a record in case this gets worse. You will have a strong harassment leg to stand on, and no landlord wants to have that hanging over their head. |

I wouldn't say anything and disregard what they say. They complain because they have nothing better to do. Once they get their money they forget all about it until the next "pay day" for them. They want their money as soon as it's due, their pay day, so they can go and buy that new canoe they wanted lol
They're not going to evict you, and as long as your lease or other papers you signed says you have a 10 day lease period then they have no legal backing anyhow.
Don't even respond to what they say and just tell them when you deposited it or sent it in. If they call and bring it up, just say your sorry and mention the 10 day grace period and they'll give you some bullshit of that the 10 day grace period is there for emergencies and isn't supposed to be used every month. Ignore it. |

If your rent is due on the 1st of the month, it's late on the 2nd of the month. The 'grace period' of which you speak means only that they aren't going to charge you a late fee if the check happens to arrive late.
As another said, get involved with online banking, where you can schedule your payment to arrive at the landlord's bank on a specific date. |

Just return their E mail with, "your E mail prompted me to review the lease, and you have received the rent before the 10th of the month as stated in the lease ".

I Buy And Sell Houses

Set up an automatic transfer from your account to your landlord's account to occur on the first. Virtually all banks offer that service. That way, the burden is on the bank, not you. (I don't know if money will be transferred on the first--your bank will be able to tell you that--but that way any "failure" to transfer on the designated date is the bank's, not yours.)
Someone else may suggest postdated checks, but I don't like those for a whole variety of reasons.

If you are so broke that you can't keep enough money in your bank account to pay a month's rent (or three months, for that matter) then you need to get a new job that pays better.
Get your check to the landlord on the first, each and every month... and if the banks will be closed, then, yes, pay it a couple of days in advance. |

I pay by rent online - takes seconds. That way you would have transferred on the 1st. If you could somehow manage to save two rents out of one months you would always have the rent there to process to arrive on the 1st.
It is really your fault for not complying - organise yourself so you are able to get it there on time. |

You are doing things correctly. As a landlord, I have always allowed the postmark to determine whether a rent check was remitted promptly.
If the negative comments continue, you may want to write a letter telling him you will start mailing your rent if you get any more criticism of your paying habits. |

Since the landlord lives in another state. No matter what day the first falls on you should mail the check three days before the first since it takes three days to get to him/her. Then ur rent is there on the due date and there is no arguement or harassment. Because ur landlord has bills to pay also and i'm quite sure he/she relies on that money to pay bills and don't want to pay them late. Banks do open on Saturdays also, in most grocery stores. |
