Missy | Rent increase before lease is up? |
do i have any rights if my landlord increases my rent before my lease is up? i thought while under a lease rent couldnt be upped until my lease is up. I have no problems with my landlord except he keeps trying to pull tricks. i cant find fair housing online...help pls! i pay 850.00 he wants to raise it to 900.00 in April but lease is up in June. we get along fine he's just money hungry/he tried to get a extra 850.00 after i had moved in (6 months) after me being here. (1700.00) was paid for my original security. my place is spotless, he agreed that i could own my cat np. and a small fish tank, no utilities are included. moving isnt a option til june according to my lease. Additional Details to make sure i went over my Lease & it says nothing about being able to raise my rent. it doesnt even mention rent hikes. there are no small prints at all he drew it up himself on his computer. |

If you have a standard one year lease, then your landlord is locked in on the rent stated in the lease. He cannot legally raise your rent, unless he and you agree to renegotiate. Pay your rent, as required by the lease and in the amount stated in the lease and to hell with him! When the lease is up, you might wish to relocate to a different complex where the land lord is more honest! |

Look at your lease contract. If there is a clause allowing the landlord to increase the rent under some conditions, he may be using that clause. If there is no such clause his request for higher rent is not valid. |

Check the fine print of your lease agreement. If it states in there that the rent can not be raised before the lease is up you don't have to pay. |

He cannot raise the lease up to $900.00 until the lease is up and have you signed a new lease with the new figures.
Otherwise he is breach of contract and can be sued...YES |

Unless the lease allows him to increase after every so often the answer is NO. He can make the request but you do not have to agree and keep paying your lease amount. I would also look at the lease to see if there are options to walk away from the lease in case terms change, which will allow you to move prior to lease expiration. |

You need to refer to your lease to see what it states about rent increases during the term of the lease. Generally, he can not increase the rent as stated in the lease, unless there are exceptions (loopholes) so you need to read it carefully. |

I have to really laugh at "can't find fair housing on line." . . . Ha! Why? What do you expect, anyway? . . . Acupuncture? The extremely overly-politicized term "fair housing" is really so frightening to most American citizens that one can NOT really laugh. It's just not funny. I guess that our sorry U.S. SH** Congress finds "fair housing" where? . . . In the 2nd Amendment of the Constitution? . . . (I wouldn't doubt it!) Yes, indeed . . .It is very sad. Your term, "money hungry" can be further broken down to read as, "Over Taxed" . . . Where is the Boston Tea Party when we need it the most? Anyway, from the information that you displayed here, it sounds like you and your landlord really do have an acceptable, binding contract. It also sounds like your landlord is a very honest person. You are so lucky. I hope you do well. Take care. |

My dear
Depends whats in the Lease and how the Lease is worded
if Lease says that its subject to increase then you have no choice, but majority of leases are not subject to increase untin the end of the Lease |

First, it would be easier to help you if you could post what state you reside in. Look up Legal Aid in your area.
Secondly, read your lease. It is a binding contract for both of you. Changes to the contract terms require agreement between both parties. The only time this may possibly occur without your agreement is if you violated any of your contract requirements.
Also, it sounds as if you have a written lease contract. This is to your advantage as you can refer to the terms easily. JUST AS BINDING, in most jurisdictions, is a verbal contract. You can also search... Landlord Tenant Law along with your state. You will be able to obtain the laws pertaining to your state.
Good Luck. |

If your lease says $850 through June, that's it. |

He shouldn't be able to increase your rent before your lease is over, as long as you signed a lease contract. If you didn't sign one, however, he can increase it all he wants because without the contract he is not legally bound. |
