My lease just expired, and I received a notice to go into the office and, renew my lease. if I stay on a month too month basis I will be charged to going rate.My problem is that I have lived there for 3yrs since then city has plastered a bunch of violations on this property office door for not being up too city codes. The pool by my apt is mess the facilities are a mess and its gotten worse this past couple of years its not safe place to live at. Yes. The tenant has no legal right to set the rate of rent. You knew your lease was expiring so you should have been looking for a new place months ago. If you are evicted you will find it almost impossible to rent a new apartment. |

Of course you can. Unless you sign a lease, they can raise their rents to you every thirty days, if they so choose, as long as they provide notice to do so. You have the choice of paying what they ask, or leaving. If you don't leave, they will evict you. |

It doesn't really matter if you feel the increase isn't worth it, or if they have been plastered with code violations...if you go month to month, they want to charge the *going rate*. If you do not pay this, yes, I would expect a pay or quit notice to appear on your door. |

YES! You do NOT get to decide what you will pay! You have to follow their rules, pay the asked rent in full or you will get evicted. It is that simple. There is no gray area here. What planet are you from that you actually thought that would be an option?
Deal with your obligations for the 2 months and move on. |

That hassle isn't worth it if you're going to move anyway. Just pay the month-to-month rate and start looking. What do you think your new apartment management is going to do when they call the current one to check your rental history and you're being evicted? |
