Our renter signed a lease, and on that lease, it said that just herself and her 2 children would be living in the home. She told us that she was separating from her husband. She called my husband yesterday and said that she needed to talk to him. Come to find out, her husband IS moving in w/ her, she just didn't want his name on the lease for "financial reasons". We're thinking she's going to try and get money from the state for aid. ANYWAY, my husband was pretty upset about it and told them that he may have to raise the rent b/c 1 more person would be living there. They of course, didn't like the idea, but I told him that I didn't think he could do that....what do you think? Any good advise from fellow landlords or maybe from some attorneys?? Additional Details When she filled out the rental application, she stated that HER income was $1300/mo and she was going to court in June for child support. Come to find out, the $1300/mo is their COMBINED income.
The only reason I didn't think we could raise the rent is b/c the renter pays the electric and gas bill, but WE pay the water and sewer. |

The lease has been violated when she moved another party in other than those that were listed. Simple so you do not get in trouble with the state because you were aware of the fraud is to EVICT.... Save yourself the hassle that is about to happen. |

I don't believe he can. However, if the amount of people in your property is violating some kind of local housing code, then you can cancel their lease and evict them.
Why is it a problem for the husband to move in? Your husband seems to be awfully judgmental. I'm not trying to insult, but what reason could he have to not want the husband to live there? And, what business is it of his?
On the flip side of the coin, it sounds like these people like to "bend" the rules. Even though they may have feared your pulling the husband's credit (not knowing that it wouldn't have mattered because she qualifies alone), that's no reason to lie. I hate to say it but they sound like they might be "problem" tenants. Is it too early to stop the process? |

I don't think you can raise the rent unless it is already written into the rental agreement that any extra people not on the lease move in you can increase the rate.
However, you do have the right to say no to him living there, and give her notice to vacate the premises for violation of the lease.
Honestly, it can't hurt to have two adults who earn income living there. It will increase the odds that they will pay the rent in full and on time. And she was honest about him moving in. Give it a try. |

The second the husband moved in, she broke the lease. If they do not want to sign a new one with him on it, evict them immediately. These people sound like scam artists who are tryng to leach off the government by using you. |

She is in violation of the lease. You asking for extra money is not unreasonable. Tell her to either pay the increase or hubby can't move in. Make sure you have her sign an addendum to the lease...notating the changes made. |

Who cares, if they are good renters count your blessings. If they aren't evict them. You should be happy that a family is getting back together, instead of sounding so selfish.
I do own rentals and this would not bother me a bit. |

You have every right to charge more. Do you have it anywhere on a written agreement that it would just be her and her two children? I'm not sure about the legalities here, but if you have a written statement you should be covered. |

You have every right to terminate the lease and keep the deposit. How dare she try to reconcile with the father of her children in a house you own. Toss them out. Look at what it's costing you! |

well in certian states you cant rasie the rent if it is in the midle of the lease year to year as oppose to a month to month .but you have to askyourself would you want the lease payment up if you just had to take a relative in then no but if she move in her whole damn other side of family then i jack it up. |

I know there is a landlord/tenant handbook. I got one years ago when I was having trouble w/a landlord. You should probably get one to make sure you always cover yourself. Try your local housing dept. or other local govt. office, or google it if you can't find one. But, if you advetised the rent for a certain rate PRIOR to knowing exactly how many people would be living there, not sure if you can raise it jsut because they lied about the number of people. Who is responsible for heat, hot water, etc.? If they are, it probably doesn't make much difference how many people live there. but yes, sounds fishy. |

If someone is living in the household that is not on the lease then that is a violation of the contract by the renter. You can either renegotiate the contract or evict them. |

if you have it as you specify on the lease, you have a suit. you could be right about wht she's trying to pull over and you could be held responsible. call a housing attorney or the state attorney and just ask a general question. you could get fined for her hijinks. it's tough being a landlord. good luck. |

hey....good for her to tell you the truth about her husband moving in...for all you know he could just be a visitor...why would you raise the rent for another person...i have never heard of that before...i think the reason for just her name on the lease is...okay....they are trying to work things out...or perhaps he was left w/o a home and she is giving him a chance to get on his feet....they are still her baby's daddy...but the main reason i think is...so if something should happen between the two of them...it is HER house...SHE is the only one on the lease...that makes it legal for her...she is on shakey ground and keeping herself safe...smart woman |

NO YOU CANNOT RAISE THE RENT. Why> bc legally she is married to her husband and they have a marriage certificate stating so. Therefore, in any other situation u might be entitled to do so, but bc she is legally married u have no authority to raise the rent. Yes, what she did was wrong, but her lease is there to protect her, and no court will side with you if she has a marriage certificate regardless of whether or not she lied. I suggest you just deal with it, what is the big deal that her husband is living there? If anything it is a benefit to know that there is a double income supporting paying the rent. |
