Renter refuses to leave!?
renter refuses to leave even though we gave him a termination notice, he hasnt paid the rent, the house is a mess and everytime we call he says that we cant do anything about it because we are far away (dont live in same city as rented house), were going this weekend to get him out and he says that if we step foot on the property he will call the police, should we contact the police for assistance???

Take the doors off the house, I always said if my renters didn't pay the doors are coming off I am not waiting that long for an eviction notice then the police to do their job. But if you don't want to go that far you are still allow to be on your property so go have dinner with him. He will give in or he will do something stupid and get arrested.

If you are in the US then the police aren't going to do anything until you have a judgment for eviction. Since you've already given him a termination notice you should be able to file a lawsuit for eviction right away. Once you win the lawsuit and get the judgment you can file for the sheriff to perform an eviction.

Make sure you have documents proving ownership with you. This is a civil matter, not a criminal one, depending on what state you live in. If your state does not have squatter laws, you may be able to get him removed for trespassing. Bring your documentation of the termination of the lease agreement, and when you arrive, call the local departments non-emergency line and explain the situation.

You may have no recourse other than eviction and the time it takes to go through the courts and get the notice served.

Do not take the doors off or change the locks until he has vacated the property and has removed all of his personal belongings. I strongly recommend you research your states landlord/tenant laws, they generally lean in favor of the tenant.

Go to the apartment and let them call the police. It will be funny when the cops force them out. IF the lease is terminated they MUST LEAVE. OR u have the right to evict them (and Bring the Sheriff). Dont use violence.

since you gave him notice to leave... you have all your right to call the police to vacant your property. If nothing happens, go to the board of lodging department and ask your rights as a proprietor. If he's not paying rent dues then you have all your right to kick him out.

Call the police for assisting in his removal. YOU own the property not him, he can't do anything, have him served.

Yes you call the police on them. Its not the other way around. If the renter wants to call the police on you... Say go ahead.

Have all your paperwork in order and go throw him out.

Let him call the police, it's your property.

You may want to think about a property management company in the future, they would take care of all of these issues for you.
