What happens if someone who is renting a room out from somebody in their house doesnt return the keys on the last day their lease is up? I would assume you just deduct the amount is costs to get the locks changed from their security deposit, but what if they did not leave a forwarding address either? Is it the landlords responsibility to call them and ask for the keys and forwarding address, or the renters?
I only ask because that is the situation I am in right now (Being the landlord)and the girls I rented rooms out in my house left without even telling me, but left the rooms and bathroom clean and tidy, but didnt return the keys or give me a forwarding address. But I know they are expecting the security deposit back bc i talked to one a week ago and she told me she wouldnt give me the keys back until i gave her the security deposit and i let her know that is not the way it works. THe two girs were best friends and really bad tenants of the house, always rude and had an attiude 24/7 Additional Details So for me, I would be happy to never see them or talk to them again in my life, but legally, I am concerned that this will come back to me by not sending them their security deposit.
It is there money, but I took enough attitude and disrespect from them that it makes me not want to get out of my way to help them to give them this money... anyway... any suggestions would helpful and anything you know about the law would be helpful too.
Bc i am just scared they may in the future lie and say they did give me a forwarding address.. |

You ARE within your rights!!!!
I understand that different locaities have different requirements. But, most are extreamly similar.
Take note (from Fairfax County, VA USA - my residence!):
"CLEANING AND VACATING: Most lease agreements require the tenant to...
The tenant is legally responsible for paying rent until all keys are returned to the possession and control of the landlord or
building manager."
As for contact, changing locks, etc - this is your home. You may do whatever is reasonably necessary for your peace of mind. You cannot finalize anything until the renters complete their resposibilities. The onus at this point is upon your renters.
(Last year I had a renter of my own with problems - the FBI came looking for her - and I don't think it was because of the short skirts)

It is not your responsibility to track them down.They should have gave you a forwarding address.That is their responsibility.
Change the locks ASAP. So they cant come back when you are gone.Hold onto the money and if they come back give it to them.Other than that you are not responsible to find them. |

They had the responsibility of informing you in WRITING that they were leaving...don't sweat this...technically they left without giving you a notice so in my mind, they owe you another month's rent.
If they didn't give you a forwarding address, that is their problem, not yours.
Go buy a new lock, install it, keep the receipt, and deduct it from the security deposit, if and when they call back wanting their money...that way you can tell them you will happily refund the balance.
They don't have a legal right to keep the keys. You can't do it an apartment without getting charged and it's no different when you are renting a room.
In fact, you have MORE of a right to change the locks right away because your personal belongings are at risk.
PS:: The main reason you need to change the locks is you have no guarantee they didn't make a copy of the keys. That is why most apartments have 'Do not Duplicate' on their keys, so that doesn't happen. |

Set a meeting place to make the exchange. You get your keys and they get their security. If they don't have the keys because they lost them, you can charge from their security the cost of replacement and the labor for installation. Save your receipts. I'm glad they left it clean for you. My last tenant caused over $1200 in damages. |

If you've spoken to them then you obviously have a number for them. You have to give the security deposit back you can't withhold it just because of a dispute. Most states have laws that have a time frame in which you have to return the money, i.e. 15 days in Florida 45 days in other states.
Pick up the phone call the girl and explain to them that you need them to return the keys, obviously they are using the keys as leverage to make you return the deposit, just tell them that if they don't return the keys you will deduct the cost of REKEYING the house from the deposit money, it's their choice, also they need to provide you IN WRITING their forwarding address for you to send the money back. Bottom line no ifs ands or butts, tell them if they don't like it then tough. |

First, I have to ask, if you have their phone number, just call them and ask for the address. I only say this because you said you spoke to one of them on the phone, If you don't have their number then:
1- Find out what the time limit is for your location for returning the deposit (here in PA it is 30 days).
2 - get the locks changed and deduct the cost of changing the locks from their security deposit.
3 - Prepare a single check made out to all the tenants returning the remainder of the security deposit.
4 - Send that envelope to the last known address for them. This is most likely the place they were renting from you. What this does is show that you tried to comply with the law by returning the deposit and sent it to the only place you knew. If by chance they did forward their mail from you place to where ever they moved it will find its way to them.

In Rhode Island you must return The deposit within two weeks of a move out,
If they don't return the keys you MUST still return deposit.
And honestly what difference does it make?? If they were up to no good they could make a $2 copy, hand you your keys and what have you gained.
Just pay them and be done with them!
Be very careful listening to those who say it is not your responsible because if they bring you to court the judge will not agree.
Obviously you are in contact. I would check all housing laws because they are very strict in application and it is the tenant that holds the cards.
Just pay them and change the locks. It is your responsibility for the locks. As another poster stated keys can be made to forbid duplication.
Take it as a lesson learned.

In response to your added response as long as you make a true good faith effort to return the deposit you will be fine.
If by chance they pull something like bringing you to court you would then have a way to pay them and case will be settled out of court. |
