I live in an apartment complex in TX . When I moved in 3 months ago I told the management that my refrigerator does not world properly . They never told me when they would come and take care of it , however, I came home today and noticed that they removed the old refrigerator and put in another used one without me being home. I have no problem with that other that they came in my apartment while I was not there. I am angered that the apartment maintenance staff did that . Is this normal or is the apartment staff obligated to give me proper notice when they were going to replace the refrigerator or enter the apartment? I simply dont like anyone in my apartment while i am not there. Who is in the right here, does anyone know? |

If you are a good tenant who pays rent on time, the landlord will usually try to respect your wish. However, the landlord had the right under the circumstance you gave. |

By telling the management that you had a problem with your refrigerator, you may have implied that they could enter at any time to make repairs. Landlords may enter in an emergency or as stipulated in your lease. It would be good practice for them to give you 24 hours notice ESPECIALLY after 3 months!! You have to weigh if it is worth making a stink over....you still have to live in this guy's building. |

Ok, I googled your answer and here is what I have come up with.
Landlord's Right to Enter
Study the lease carefully to determine the circumstances under which the landlord may enter your home. Unless the lease agreement says the landlord can enter your apartment or house, he has NO right to do so, except perhaps in emergencies and for routine inspections or repairs when you are given advance notice. In every residential lease (oral or written) a tenant has an implied right to peaceable, quiet enjoyment of the premises. A tenant also has a right of privacy in his own home. A landlord should not violate either of these rights by entering without the tenant's permission or before giving advance notice, regardless of what the lease says.
The link to that paragraph is below. Basically unless your lease otherwise states, your landlord or anyone else for that matter should not be in your premises without your consent. I hope that helped. |

I think they should have told you. I would be upset too. Theres not much you can do about it -nothings missing right- but you should tell them for future reference that you absolutely need a courtesy call if any repairs need to be done, so you can plan to be there. |

Generally a landlord is to give you a 24 hour notice your best bet would be to get a copy of the state laws in your area to keep handy for incidents like this. |

Yes, it is his house. But I believe he is suppose to let you know ahead of time. But my landlord come in some times while I'm at work and does repairs and things. |

I think in most places, Texas included, they have to give you 24 hour notice before entering your apartment unless it's an emergency which a broken refrigerator is not. However, since you were the one who asked them to come look at the fridge, I'm not really sure who's right. But I think they were supposed to at least leave a note for you letting you know they entered your apartment and replaced your fridge. |

For any other non-emergency reason, they usually need to give you notice. Not get permission, just give notice. |

Read your lease or rental contract. In my state, renters have legal rights that you may not have where you live, but your lease or contract should state clearly how and when others can enter your apartment. They should have notified you of the time of arrival and asked if it was okay to enter without you there ... but that is the LAW in my state, and may not be the law in your state. If you have questions on renter's rights, call the City Hall information site and ask them for whatever they have for both 'renter's rights' and 'tenant's rights' ... then READ IT ... |

While I don't know the laws in Texas, while I rented in Massachusetts they could come into your apartment uninvited during an emergency (fire, flood, etc) but for any other time they had to give you 24 hours notice. |

The only time a landlord can enter a rented property/premise without notice is if there is and emergency..but if there isnt and emergency such as your refrig or fire or pipes leaking etc..they just cant come into your house for no reason while your not home..now out there in Texas I have no idea if there allowed to do that..I would sure hope not would be like invasion of privacy..the landlord cannot enter to simply inspect how the tenant is using premises. also .the landlord has to have a valid purpose and then they have to give you notice of intention to enter such as repairs.. |
