Renting In Today's Market & Avoiding Scams?
After many years we've decided to rent again. Of course we will be checking with our local rental agencies but due to the low volume of what's available in our area we would like to consider all options i.e. renting from owner. We have also been browsing craigslist which we've heard if rife with housing scams right now. So my questions are:

1) Are there any agencies, whatever that we can check with to ensure that we are dealing with the actual owner (or agent for the owner)? And how would we go about that?

2) How can we ensure that a rental is not getting ready to foreclose or in foreclosure?

Any other advice I'm not thinking of right now. We will be starting our search next week and I want to be prepared. I appreciate any first hand knowledge/experience. Thanks.

@Wildcat.. Thank You. We have no interest in being nosey. we just want to protect ourselves. If an owner/agent is honest about the possibility of a short term rental because of a foreclosure that's one thing. I am talking about people that are renting houses and not disclosing the possibility, signing a lease/agreement for a year or two and then the bank comes knocking a month later. Would that not be considered fraud (or whatever)? Is there no way to protect yourself from this?

Well I to was about to get scammed on Craiglist. I found someone who said they will rent me their home and we searched if they owned the home and it said he did. But then we came across something on the internet and said to watch out for those scammers and it said the same story he told us. Luckily we found out on time and weren't scammed. He kept repeating that he was leaving for missionary work in another country and will fly in every 4 months or so. We're not really sure if it was him, himself scamming people or he simply used the owners' name and pretended to be them. So, I would recommend you to talk to a realtor or walk along the neighborhood you would like to live in to see if they have any renting signs so you can avoid any scams. Hope that helped.

1: You have no guarantees on that. You can check your local tax records to se if the person you are talking to is the owner of record, but just because the person you are talking to is not the owner of record does NOT mean that they are not an authorized agent of the owner. If they have a property manager then you will never meet the actual owner or have any right to know who they are.

2: Again, you have no guarantees there. You can search court records to see if a foreclosure has been field but that is it. You have no right to their financial information, so if they are behind but nothing has been filed yet you have no right to the information. Tenants have protection under foreclosure so there is no need to panic over that. FYI, it is legal to rent out a house that is in foreclosure. The owner has every right to rent it out up until the day the foreclosure goes through and they no longer own it.

I know it does not seem fair that the landlord is entitled to all of your personal information & you are not entitled to anything but their name, but that is just how it works. You will find that there are many aspects to renting that are not fair but legal.

They are suposed to let you know it is in foreclsoure but there would not be anything you could do about it if they did not. As I said, it IS legal to rent out a house that is in foreclosure. People forget that they DO still own the house all the way through the foreclosure that can take months to years to completly go through. It would only be fraud if the bank had already taken possesion of the property at the time you signed the lease. As long as they still legaly own it on the day you sign then no fraud has happened.

"Is there no way to protect yourself from this?" There is no way to 100% avoid renting a place that is in foreclosure but as I said there is a federal law protecting you if it does happen.
