Renting a house, water pipe break-who pays the overage on water bill? Renter or owner?
Owners simply told us that we were going to have to find somewhere else to stay until the standing water under the house is gone & the plumbers are able to fix it. No time line, at least two weeks is the only info we got. Water pipe break is under ground. Last month the water bill was $260.00!!! I went up to the city offices right away, they had just been there that morning to read the meter, & within the 12 days from the beg of the billing cycle to that day we had gone thru 80,000 gallons of water! Which was more than last month. The owners are holding us responsible for the entire water bill. We are more than happy to pay our share, but feel it is not fair for us to pay the entire bill. Any comments or suggestions? Also very concerned about mold in house now, as we have small children, one with health problems already. House already smells of mold & mildew. Any help will be greatly appreciated!!

Wow! Sounds like you got yourself a slumlord. I had one of those as well. You need to go over your lease and make sure there isn't anything like this situation in there, because if they already knew about your weak pipes, they might have weaseled it in there somewhere. I doubt it, though. Anyway, it's their responsibility. Tell them unless they pay for it and ALSO reimburse you for the few weeks you have to find somewhere else to live at, you will be contacting your local HUD office. That should change their tune. It most certainly is NOT fair for you to pay it, you do not own the house. Your landlord does. Therefore, whatever mechanical problems the house has needs to be fixed BY the landlord, out of THEIR pocket. Make sure he doesn't use your security deposit for this situation, either.

You shouldn't pay that water bill, his fault.
You won't be living there a few weeks, he needs to lower the rent for that month OR drop it if it's four weeks.
Make sure he does not use your security deposit.

He might argue and say you don't know what you're talking about but trust me, my renting experiences were like this and I won the battles. Good luck! :)

Its not your responsibility. And if you can prove the mold and mildew are at harmful levels (there are test for this) you can get out of your lease. I think its time to get a lawyer.

if you alert the city (water company) to what happened they usually take care of it (this happened to me) you have to write what happened what date..ect...

usually the CITY cannot hold you responsible for something like that unless you caused the pipe 2 break, which is highly unlikely.

so go back to the water company, tell them what happened they know a family doesnt use that much water, have your dates with you and when someone came to fix it

about the mold, the landlord needs to fix that, that is very dangerous to your health to live with

The landlord should put you up somewhere while it is being repaired. His insurance would cover the costs.

If $260 a month is high (it is to me) you should have alerted the landlord or the city immediately as something was wrong. As a tenant you have a responsibility to let the landlord know immediately if something is not right so that it can be repaired and to minimize the damages. There was also probably a low pressure situation that you should have noticed in the faucets, shower, etc

The landlord should have a professional service clean the damaged area and treat for any mold growth while you are living somewhere else.

As a landlord, I personally would probably work out something with you on the water bill. But I believe you are actually responsible for the bill by law.

You have grounds for a "constructive eviction", which is where you can notify the landlord and move out permanently, with the lease void, except for the return of the deposits.

You can move sometimes within a few hours of the situation is that bad. And no water for 2 weeks, and an 80,000 gallon leak in12 days is that bad ...

... look up the residential landlord and tenant laws for your state and get the papers sent out NOW. It's under "Failure to maintain".

The landlords legal responsibility is to maintain the premises in a habitably condiiton,and a swimming-pool's worth of water under the house is NOT habitable.

As for the bill, you may have to pay it, but you can sue the landlord for the difference the broken pipe made because of the failure to maintain - the difference between last year and this year is reasonable. You can also sue for return of the rent for the time the place is uninhabitable.

Sounds like a bad landlord to have!!! You should get more than one bill, about 3 would be fine to show the landlord how much your water bill normally is, and explain nicely that he needs to pay the rest, or take it off your rent. Get the answer in writing if he says he will pay!!!! If he refuses to pay, you are stuck. You could hold it out of your rent with a letter explaining the exact amount held and why. He would have to take it to small claims court to get the money back. That costs the landlord a few hundred bucks plus time off work. Doubt he will want to do that.

The person on the bill pays it. If the landlord requires you to move out with a vague timeline I would consider simply moving out permanently. You have to look out for your family's interest.

Don't forget this is a totally unforeseen problem to the landlord, too, so he is at his wits' end. But he should have insurance to cover all damages, including loss of rental income.

Laws differ in various areas, but most jurisdictions state that the owner is liable for the bill unless the tenant was responsible for the damage. If you didn't cause the leak, you should not be responsible for the payment of the bill or for damages caused by the leak or for the cost of repair. The landlord should have insurance to cover these costs.
Be sure to keep everything in writing and go to your local landlord/tenant resolution board for help. Mold and other potentially dangerous conditions are grounds for breaking a lease.

Depending on your home state, your property owners are responsible for the upkeep and repair of their property.  Please dig  out your rental agreement ~ beings the pipe was Underground, it shouldn't be your responsibility~ If the pipe was outside the property line, it's the city's responsibility. Inside the property line, it's the OWNER's responsibility. Please talk to your water company, and work out a payment plan so they don't shut off your water.  Then grab the phone book, and call the Legal Assistance phone #  to recoup your money, and demand repairs to your damaged  dwelling~  Best of luck to you 'n yours!

The property owner is responsible for the water bill even if the bill is in your name. If I was you I would move and I certainly wouldn't pay the water bill. You should only pay the estimated amount of water that you normally use. You are not responsible for his property breaking because it is old and faulty. I would move and go to the water dept and explain and pay what you normally pay and tell them that you are out of there and to take your name off of the bill. If that doesn't work get a legal aid attorney for free.
