I do not think it is legal in any state other then Hawaii. However, a fireplace counts as heating.
You can not put "no heat" in the "contract" as it violates real estate law. |

its perfectly legal. Houses do not HAVE to have heating in them. Make sure any tenant knows there is no heating in the house and there shouldnt be a problem. |

if you accept a tennancy without heating in the house, then you have no grounds for complaint, the issue needs arising before you rent. |

There is no law to say that a house has to provide heating for the tennant. If you were to state that it had central heating and then it didn't then that would be a different matter but I have a friend who rented 2 rooms in her house and she didn't have any heating at all and there was no problems. |

As a lettings administrator for an estate agency, I can tell you that it is quite legal. You certainly cannot move into a property that was not heated and then complain. The only legal requirements in an unfurnished let are smoke alarms and cooking facilities. Anything else is up to the landlord. If your heating broke down, you could complain, but not if you had none in the first place. |

Yes it is ok for a tenant to move into a house as long as theres an electric point for an electric heater to be plugged in somewhere in the property. You won't be able to move in and complain because if you move into the property you move in to oit and sign the agreement as seen. If the Landlord agrees to put one in when you move get this in writing and signed and dated. Check on the shelter website for your legal rights. |

Providing the lease states that there is no heating in the property yes it is legal. However most agencies would advise that heating was put in place in order for you to ask for more rent. Make sure if heaters are being left in the property make sure that they are on the iteneray and are checked by expert ie corgi or electrician. |

As a landlord it would be a part of your duty of care to provide heating. If not you would be liable as having failed under a duty of care. Its one of the those inflexible things that cannot be avoided by altering the contract as the law would overide it. |

The law depends on where you live. I know certain parts of NJ (beach front properties) do not require heat if they are only rented out in the summer. As soon as you rent the apartment past the month of September it must be heated. I am sure your area has a similar law. You can probably find it here: http://rentalrights.net/ |

In the UK,i think it's in the legal contract that the landlord has to provide you with a way to get heating,either via electric or gas (you have to hook these up yourself,but the equipment/system or a way to have these hooked up has to be provided) and they also have to provide you with one method of maintaining food,either it be a fridge or a hob.
I don't think this should differ from landlord to landlord as it's the law. |
