I Love My Kitties | Renting an apartment...and I just found black mold in several places....what to do? |
I live in a quadplex... its basically 3 rooms (Bedroom, Bathroom, and Living/Dining/Kitchen) roughly 500-600 sq ft. These apartments were made pretty cheap... and our toilet & bathtub overflowed two times because the neighbor had stopped up the pipes (causing every apt to flood somewhat). Its been awhile since then, and I recently moved the washer and dryer (in the bathroom) over to reach for clothes that fell behind/beside them and noticed a lot of black mold rotting out the wall near the bottom of the floor....the baseboard doesnt seem very damaged compared to the wall. Im not sure it the overflowing was the result of the mold (I wasnt home...I came home after work and noticed toilet shreds all over the bathroom floor and it had worked its way to my bedroom near the bathroom door).
Also, I was doing major cleaning and decided to empty out the contents under my kitchen sink...only to find mold there too...Im guessing something leakes (which I know the fridge has 2-3 times before). Additional Details So what should and what can I do about this? Will I be penalized for it...I just noticed it recently...? |

Well I would first contact the landlord and let him know what you found, no he should not blame you, since the apt was flooded in the past and doesn't have the proper ventilation. If he does nothing about this issue within a week or so, don't keep pestering him, this is an issue that once you tell him about he should be on top of it, like getting someone out to look at it the next day. Black mold is toxic and can cause you to get very sick. If he does nothing about the issue, you need to contact the health dept, and let them know that you think that your apt may have black mold in it and that your landlord is not willing to do anything to fix this issue and you need for them to come out and inspect the apt. They will set up an appt with you to come out and test the mold to make sure that it is black mold. There are many different types of mold and most do look like black mold and they may not be that. The health dept. will come out, and if it is black mold they will more than likely make you move out, if that happens your landlord will either have to let you break your lease and give you your deposit back and may help you with moving costs, or if it's not toxic they will let you stay and they will file a complaint with the landlord and they will give him a time frame to get the problem fixed by and if he doesn't then they can take away his renters license and make all the tenants move out. |

First of all he owns the place, it is his responsibility. He can't penalize you. He should be greatful that you noticed it now. You can use a 10% bleach/90% hot water solution- put it on with a mop & let it sit for 15minutes. It will kill the mold- even though some of the black color remains. At least stop the health hazard part. Also there are 10000 different strains of mold. Most are not dangerous.
I had the same situation about a month ago- we own our home & homeowners did not cover. I ended up calling a restoration company that cleans up after fire/flood & they told me the bleach thing. Also check out the EPA website for this same info. As for the hotel- if he needs you out to make any repairs I would ask him for hotel. If he makes you leave then he should be responsible I think or at least pro-rate your rent for the days you can't be there. |

That black mold is toxic! Tell your landlord immediately! You should not be held responsible. It needs to be fixed or you need to report it and move. It is not worth the health risk |

Keep reciepts of any thing special you need to clean this , you should be reinburst, if you have to clean after repairs. I would remind landlord this could cause health problems if he balks at refund or taking it off rent. If it gets worse contact your code control for more information on help. Also take photos for future need be. |

Mold is nothing to play with and any landlord who is not a total moron knows that.
Contact him in writing (preferably certified, return receipt requested) and tell him what you found, when, and how. It would not hurt to have a few pix and I'd include the front page of that day's newspaper with it and keep copies of what you send.
I suspect this will take more than a day and he should put you up really.
He should call folks that understand mold remediation. Sounds like at least some drywall needs to come out, some chem treatment, repair, painting, etc. Sounds like under the sink needs to be ripped out and replaced as well.
He may well gripe at you that you should have noticed, but honestly most folks don't check those areas very often. If he was aware of a toilet overflow HE should have inspected the units although I agree YOU should have as well. Still seems it's his issue to deal with.
Anyway purpose of this in writing is that you will have served notice and you'll have a record of exactly what you reported, when, etc. because this COULD cost him some bucks (mold can grow up and down inside the wall area for example) and that can cost some bucks.
Be prepared for him to be mad at you--that's just the way some people are.
Good luck and do this ASAP as mold of all sorts is not good for you; black mold tends to be very nasty. The less contact, the better. |

Contact your landlord. Mold can cause serious health issues and sometimes death. You need to get it taken care of immediately. If it is rotting out the wall, the wall will most likely need to be torn out and replaced. |
