Hello, I’ve been renting from my landlord since 3/26/08. Our hot water heater broke on 4/4/08. when we called the landlord, she said to call PG&E.
I make an appointment for the soonest date available HOWEVER, PG&E is only permitted to light the heater and check the lines for safety. PG&E does not make repairs rather than test the unit for safety and refer us to a service company.
My first question is “does a broken hot water heater make a rental unit uninhabitable?†Additional Details I checked out the web site for CA Consumer Affairs, I think I understand what I need to do. 1) call landlord and report problem [I did that and she said to call PG&E] 2) Send a letter stating the problem[make a copy for her and one for my files], mail it certified mail [that way, I get a post card notice that she received the letter]
If I can get a free quote to repair the hot water heater, should I do so and send to the land lord? What if she says I can deduct the costs of repairs out of rent? How can I document her approval to allow the deduction? [my previous landlord said we could, and then took us to court because we didn’t pay the full amount of rent? ] |

You need to check your local housing codes, but it most parts of the country, lack of running hot water is a violation of housing codes, and your landlord is legally required to get it fixed. If she does not fix the problem, you can (and should) sue her. |

PG&E is correct and your landlord is wrong. She needs to call a plumber to repair or replace the water heater. |

We I have the same problem over here in uk. Its now a week and it hasnt been fixed! Its all very well people stating hot water is a luxury, but how many weeks is one supposed to go without having a bath or shower? |

check out www.dca.ca.gov California tenants I'm reading the book and it states A dwelling also ma be considered uninhabitable (unlivable) if it substantially lacks any of the following: Plumbing facilities in good working order, including hot and cold running water, connected to a sewage disposal system.
Check out that website I also recommend getting a copy of the book they will send out for free. |

Yes. Hot water is considered an essential service. Your landlord has a 72 hour window to fix an emergency before you can take an action on your own. |

yes, in Texas you can write a letter (always make copies and keep your requests in writing) to get maintenece on it. if they don't respond within a reasonable amount of time(i'd say a few days), then you can legally break your lease after three letters with no fixes and get the hell out of there. get a copy of your lease to check out the details (it may be different from TX) |

I would think so. Call the housing bureau and report this offense. And stop paying rent until it's fixed! Or have it fixed and deduct the amount from the rent. keep all receipts and verify everything in writing. |

Not uninhabitable, but very inconvenient. It takes a long time to heat up pots of water on the stove, but hey, people have done it before. |
