Renting with no tenancy agreement, do I have to pay?
I have been renting a place for about 6 months, my partner left me and I had to apply for housing benefit. Anyway, it's taken over 9 weeks for the council to sort out the rent andf they still haven't managed it, meanwhile I have been given notice by my landlord. I have been offered somewhere to live by my dad, and I'm sick of my landlord coming round and shouting at me, so what I am asking is, if I run off and get out of here with my daughters, am I still obliged to pay the landlord as I signed no lease? If you didn't sign a lease you shouldn't be there.

If your partner had the place in his name and you moved in you had no right unless you had told the landlord and got his agreement.

The fact you have been there and have claimed 'rent' from the council means you must have some sort of agreement or they would not process your claim.

Yes you could just do 'a runner' but hopefully the landlord will chase you until he gets money out of you.

Why should you live somewhere at someone else's expense???
Why would you think that is acceptable???

if you signed no lease you can leave anytime at all....
but itwould be polite to let them know, and be careful without a lease, the landlord can throw you out too

technically, I don't think you have to pay, but that is a pretty scumbag move on your part. You don't like your landlord, that is fine and well, you have the option to leave there. But to stiff someone on a bill that you know you are obligated too is just cheap, and disgusting. If you like looking in the mirror knowing that you take advantage of people, and it makes you feel good about yourself, then by all means. And certainly teaching your kids this is proper behavior will go a long way in helping a country that is already in a moral and value decline.

Why should you not pay? we all have to pay and i'm sure he didn't say he would pay for you to live in his flat! If you don't you will be unable to get rented accommodation in future as it will show you as a non-payer so no one will touch you and i wouldn't blame them.

When you stay in a residence, without benefit of a tenancy agreement, your obligations are defined as a month to month tenant, meaning you have to pay your rent up to the end of the month after which you have given notice of your intent to vacate.
Thus if you give notice Nov 19, you owe rent to the end of December. If you wait to Dec 1 to give notice, you owe rent to the end of January. The same rule applies in reverse if the landlord wants you to leave. The landlord can force you to leave by giving notice at least one full month before you my be required to leave.

If the landlord gives you notice to leave, and you decide to leave immediately, that removes your requirement to give notice. If you have given notice that does not remove the landlord's obligation to give notice to force you out. So if you give 5 months notice and the landlord wants you out earlier, the landlord must give notice a full month before you must go.

i agree with what margaret says, if u have not supplied the council with a copy of the tenancy agreement they wont process the claim have u checked that they are working on it? i also think if the agreement is not in yr name they wont be able to pay u housing benefit anyway. it is wrong of yr landlord to come round shouting at u that achieves nothing. tell him calmly (if u havent already) the situation and that it is being processed by the council (having checked it is!) also tell himthat if he is not happy with that then he has to serve u with legal notice to quit in accordance to the law. if ur not paying rent what about council tax? u apply for council tax benefit same time as housing if not already they will be chasing u for outstanding council tax soon too.

if u dont want to stay there then go and live with yr dad when the money comes thru give it to the landlord. one point however if u live with yr dad then u wont be entitled to housing benefit tho if ur on income support yr dad may get a discount on council tax for that, check with yr council.

A proper landlord would not rent out a property without some sort of agreement, and you shouldnt be able to claim housing benefit without one either. What are you showing them as proof of rent? A landlord is not allowed to come round and shout at you either. It is called harrassment and he can get into a lot of trouble for it. Speak to your local housing officer. They are there to help you in situations like this.

Incidentally, a landlord is not allowed to hassle you for payment while you are waiting for a housing benefit claim, if he agreed to accept it to pay your rent.

Well here's the score.

Despite there being no formal contract in place, you paying the rent constitutes "An Agreement".

If you're partner is on the initial lease then it confuses things a little, so lets fo now assume not.

If there is "An Agreement" in place given that you pay rent, and he allows you to live in his property, then you are in a contract.

However. As there are no writen terms of the contract, you are in effect under a periodicle contract. As such you need to give him one months notice to quit

Of course you could discuss this with the landlord and he may allow you to leave sooner.

Alternativly, given the global market at the moment, he may offer you a fixed term contract at a lower rate, just to ensure that the property is filled and he has some income.

It's best to speak to him.

Remember that you may need a reference from this landlord, and if you're deposit is registered under one of the tenancy deposit schemes (Which it should be) and there are needs for deductions, this will flag up on future rentals when they run a background search on you.

So best to keep him in the loop really!!

People have mortgages to pay, he probably pays his with the rent he gets from you (or not!!) and if you "do a runner" without paying rent that is owed, personally I think that is disgusting. If you were my tenant, I wouldn't sleep until I got what was owed.

You're playing a pay-or-die game or what. You live there,but say that you don't live there. You don't have even a name. I think a runaway bride because she ignores to pay her rent doesn't sound good. Talk to the landlord that you can't pay the rent, and you will move out as soon as possible. Ask your parent for help. No one wants to let you die. Take care of your baby and yourself.

you must be at least in 8 weeks worth of arrears for the landlord to be able to issue you a notice to quit the simple answer is yes you can do a runner be they will always find you they can apply to benefits for your new address and or council tax they will take you to court and get the money stopped out of your benefits or force you to sell assets.. plus as well when your claim for housing benefit is sorted, you will have received money that you are not entitled to therefore frauding benefits agency which in some cases can mean a jail term. if i was you id tell your landlord whats going on and ask him to apply for your housing benefit direct.

All councils have a housing benefit web site which gives full facts.In fact you can work out on them how much money your entitled to.You also have
to think about the money you claimed for coming in the post.You are entitled to that.Will your landlord cash it?Or has he cashed it.Go back and
complain and be sure you have given or give a bank-building society account for it to be paid into.If your father fix's you up.Once you get payment go the benefit office and let them know your out.Then you can
switch your claim to where you are.IE paying your dad.
