I live in a house with two other people. 2 days ago, one of them was arrested and is currently in jail on 4 felony charges.
My first, most important question, is that rent is due in a week. And neither my other roommate or I have the money to front his part of the rent. I know we can't do much about what he didn't pay for utilities, that's our loss, but what is going to happen re rent payments? He is on the lease (along with myself and my other roommate), and we are 2.5 months into a year lease.
Second, we need to make sure regardless of him getting out of jail that he is NOT allowed to stay at the house. We knew nothing of his criminal activity and never want to deal with him again, let alone live with him. We want to have our lock changed, etc. I don't count on him posting bail but if he does, we do not want him coming into the house. What can we do about this? |

Where I live the FULL amount of rent is due regardless of the circumstances. You and your roommates are going to have to get his name off the lease. I don't know how your landlord will handle this, but here, I need signatures of all parties involved. |

if you can't get the rent money from the Perp roommate, you are legally required to pay it yourself, because you two are on the lease - talk to the landlord about allowing you to remove him from lease and getting another roommate - you two still have to pay the FULL rent in the meantime |

In jail or not, the rent is due and if not paid the landlord has the right to evict all of you for breach of contract. Naturally that will have a negative effect on your credit since your all on the lease. By all means inform the landlord of the situation but the remaining leasee's on the lease is still liable for the remainder of the lease. Re-renting to another roomate may open up another can of worms. If your jailbird friend gets out he is still entitled live there just as long as he pays rent. |

You're going to have to talk to the landlord about this situation. You can't change the locks, but he can. You can't evict him but your landlord can. As far as the rent is concerned, the landlord is going to want the entire amount regardless of the circumstances. If you can't come up with it he is totally within his rights to start eviction proceedings against the two of you.
Talk to the landlord, explain the situation, and see what he's willing to do. He can't want a convict in his unit either, so all of you are basically on the same side here. |

This is one of the downfall of having roomates. You are all collectively responsible for rent. If someone can't afford it, everyone else has to pay it. Period.
As to changing the locks and eviction... it is *not* legal for you to change the locks without your Landlord's permission. Usually it's the landlord who does the changing of the locks (and he can charge for that too btw). In addition, i'm sure he won't want to rent to that guy who got arrested. So, he can choose to evict that one person from the lease due to his current and future inability to pay rent and then allow you to find another roomate to replace him.
Basically, what I'm saying is.... talk to your landlord before you do anything. |

As already stated, the landlord will be expecting the rent in full. He does not care who pays what part, just that he gets the full payment. The landlord can begin the eviction process due to non-payment and he does not have to accept partial rent.
The jailbird roomie cannot be removed from the lease unless all parties - including the jailbird agree to it in writing.
Neither you nor the landlord can stop him from returning and staying at the house, nor can the locks be changed - the jailbird has a legally binding lease and has every right to stay there.
If you are all listed as joint tenants on the lease, the landlord cannot evict only the jailbird from the house. It's everyone or no one. An eviction action is asking a court to give the landlord possession of the premises, which means everyone must go.
The landlord can evict all of you and then turn around and rent to just the two of you - if he wants to. |

The landlord is going to want the payments regardless of what happened to him. I would say it is perfectly reaasonable to get a room mate to replace him and relate the circumstances to the landlord in writing, and send a copy of the letter to this individual in prison. |
