Roomate 3 day notice?
My roomate just decided she wants to move out at the end of May. Her plan was to move out july 1st and because the new place she wanted to move-in couldn't keep the place til then, she decided she was gonna move-out.
I live in Cali. What are her legal responsibilities? I know that we have to give a 30-day notice . I am planning to stay in the apartment and landlords told me it is betwen my roomate and I to figure it out and pay the June's rent. We both signed a month to month lease.
I am really frustrated for such a short notice. I don not think that she can just leave with the burden in me. It is also very hard to reason with her. I appreciate all the advice.

Legally she owes you for the month of June. If she fails to pay..you would need to persue it in small claims court. BTW...you do not need to give her 30 days notice since she is moving out.

If she signed a lease for June she is responsible for her share of the rent....if she doesn't pay, take her to small claims court.


Not sure how old you are, and I know when you're in your early 20's and barely making any money you often need help paying the bills, BUT...Roommates SUCK!! All of them! Even if it's your best friend...sh*t like this will always happen. Try to live on your own...no roommates, You'll be much happier.

If she signed the lease with you then yes she is legally responsible to help you pay for it. But that doesn't mean she will. Unfortunately if it doesn't get paid then you both will have the negative renters history. Your best bet is to talk to her and try to reach some kind of arrangement. If she refuses, the only way you will see that money is if you find a way to pay the rent and take her to court for half.

The situation with the other apartment does not effect the current lease. Her obligation to you is the same regardless of why or when she decides to moves out. She must give you at least 30 days notice to stop paying rent and that notice must end on a rent payment date. By these rules she is obligated to pay you for June rent. If your feeling generous you could say 30 days from the day she informed you of the change, and accept a partial payment for June, but that is between you and her and has nothing to do with the law. I've known several people who have paid dual rent for a month for this very reason. It does have the advantage of giving her a whole month to move her stuff instead of all at once, which could save her money on a truck rental.

Your choices are to sue her for June's rent for not giving notice if you pay the whole thing.

Or pay your half, give your thirty days notice, and let the landlord go after her. You move out the end of next month.

Roomates are considered a single entity in terms of a lease, so you are both equally liable for rent and lease. However, in reverse each party is liable for the rent in FULL whether both live there or not. If you do not pay your rent in full, the landlord can serve a 3-day notice. You can not just pay your one half of rent and say the other person moved out. Your landlord is right that the problem is, unfortunately, yours to solve.

Your options are to cough up the full month's rent and send in your 30-days notice at the same time. Or, quickly find a new roomate and stay in the apartment.

Who put up the security deposit? If you provided the full amount, obtain a reasonable amount from your new roommate. This will help your immediate situation. If your exiting roommate put up half, then it could be forefited by non payment of rent (attempt this reason with her).

Any occupancy changes usually will have to be agreed upon by your landlord. Inform them of the situation, do whatever you can to make good on the rent. Your landlord is not obligated to help you with this situation, though. Your landlord may cooperate with an early move-out if they can show and re-rent the unit quickly so if they offer this as an option, you may be wise to accept.

I would seek legal advice. One thought I have is since the landlord is being passive about the situation. Let the landlord know your intentions. If you plan to move out but need more time, check the fine print on your rental agreement and see if there is a per diem on the contract. If you plan to stay, are you able to cover the rent until you find another room mate? Good luck!

Is she on the lease or are you subletting to her?

Either way, the Landlord has to be paid the full amount. If its not paid, he will have to evict both of you.

If she does not give you 30 days notices, you can sue her for her part of 1 month's rent.

Unfortunately, like your landlord said, it is up to you to come up with the rent and find another roomate, regardless of what happens between you and your roomate. You probably won't see the money from the roomate. Not very fair, but that's the way it is. Good luck.
