Roomate gone, can I sue for rent?
Me & my former roomate got into a big dispute. He moved out, we both signed the lease. There are still 5 months left on the lease, what can I do to hold him to his 1/2 of the rent if possible?

First talk to him about it. If he will net honor his obligation, send him a registered letter, with a copy of the lease and that he is responsible as you are on the lease. That you intend to seek legal remedy should he not respond.
My guess is that he will blow you off. If you can't make the lease payment on your own for a couple months even if you get a judgement on him, your credit will get screwed.
Truly, if he won't work it out, send him a letter, then call a lawyer. Often times a strongly worded letter from a lawyer will "motivate" him to pay up...

hahaha, been there before. Even though we were both on the lease, she up and moved 2 months into it, and back then I couldn't afford the whole rent. I called the leasing office as she was moving out to give them a heads up, so incase I had to break MY lease, I wouldn't be held accountable due to the situation. They didn't care. Whoever is left standing is the one holding the bag.
I took her to small claims court, she didn't show. I won the judgement in court to garnish her wages, and THEY didn't even help! It was like, You win, case closed, next.
So I had to totally go underground to get her current info of where she was working, when I finally got it, her wages got garnished once, and then she quit! Hahahahahaha. 3 years later, she ended up marrying my brother, WTF! Hahahaha. She was a childhood friend who screwed me over, happens everyday. They are since divorced, but the point is, if you are theone still there, you are the one responsible. You CAN win in small claims court and get his wages garnished, but it's all a huge pain in the a**. Myabe you should just try to talk to him and reason withhim that heis leaving you a little high and dry, espeically if it was a surprise move out, like mine.

since you both signed the lease, you are both equally obligated to pay 100% of the rent.
if one of you died, the other is still obligated to pay the entire rent.

If he moved out on his accord, yes you can sue. If you kicked him out, you can't win anything.

You could also sue for utilities.

Well, to sue you have to have been damaged and in your case as a direct result of a broken promise (contract) that you relied on. Now to prove your allegations you go to court and hope that you got your facts right and hopefully you are represented by legal counsel. Especially if the judge had a bad night before your trial and you remind him/her of it at trial.

why would you want to sue it was probably just am argument i always say you are not true friends unless you get in a fight. If you sue him you will really mess up your relationship with him. But if you really need the money sue him but me i wouldn't. If you want to sue him go to court get a copy of the lease bring it to court take it up with the judge and just see what happens!

He is definately responsible for half the rent if he signed the lease, too. But, if he is paying, he may decide to move back in, and do you want that? If you don't want him there, then maybe you should try to find another roommate fast.

You have a month to get a new roommate. For that month you are entitled to 1/2 of the rent. However, you will not get 1/2 of the rent for all 5 months left since it is your fault you could have gotten another roommate
