Roommate moved out on the 31st, has not given key back?


Our horrible roommate moved out on November 31st and has not given us our key yet or provided a forwarding address. He paid a deposit and from it will already be subtracted a late fee for last months rent and damage to our heater. He said he would bring the key yesterday at 4 but never showed up. I’m worried that he will come in when we are gone and steal things. I tried to call him today but he hug up on me right away. I also can’t return the remaining portion of his security deposit if he does not give me a forwarding address. What are my rights and what can I do. I own my home and rented the room to him. If you need more info please ask and I will reply asap! I live in WA state if that means anything.

Sorry I did mean the 30th.

Swap out your locks, and call a locksmith tomorrow ASAP to do so. Difficult people like that arent worth fighting with. Just let him know if he doesnt provide a forwarding address, his mail will go in the trash.

Also, did you sign a formal rental agreement with him? If it was done "under the table", and no legal documents were signed, and he's going to be a jerk and hang up on you, keep that deposit and like I said change the locks and toss his mail.

You seem very nice and going about it the right way, but what can you do if he doesnt comply?

First, there is no November 31, so you most likely meant November 30.

Change all locks in your home. You should do that whenever a tenant moves out anyhow. You give them one key, but you usually have no way to control whether they get duplicates made.

Also, send him a letter detailing the damage done, and how much the repairs will be (or cost), and itemize his deposit and what he will be getting back. Then mail it to your address certified return receipt so you have proof if he does get it.

This shows the courts that you did attempt to contact him through his last known address. Because you need to be prepared that he will go to court to say you didn't return his security depsosit.

And, if he does show up, and gives you the key, you can give him the remainder of the security deposit, and can do that even if he doesn't return the now useless key.

You need to change the locks on your door. Use the money from his security deposit to change the locks.

You have done nothing wrong. For your safety you must change the locks. It is his fault that he did not return the key. You are within your right to use his security deposit money to get the locks changed.

If I were you I would not worry about him taking you to court. He has no case.

If you are the owner of your residence, just replace the lock. You can also remove the door knob or dead bolt and replace the cylinder. If you are renting, ask the management to install a new deadbolt cylinder in your door. If you know how to do it yourself, or know someone who does, get it changed and notify the management. If the management changes the lock, you will probably be charged. Be prepared to provide the rental office with a key if you do it yourself.

Change the lock, it's easy and considering the possibilities cheap. Inform the Landlord immediately, tell him/her your intentions and make provisions to give them a key A.S.A.P. If your Landlord objects tell them 24 hrs for them to change the lock set or you have no choice but to protect your property. In my experience any improvement that doesn't cost them time or money is okay. This is a real problem and unless they're newbie landlords they will secure the premises promptly. Changing the lock without informing and providing a key to the landlord is grounds for eviction.

You need to change that lock even if he gave the key back. You don't know if he or someone else has another.
You MUST put the security deposit in yhe bank until such time that you have a forwarding address or you have served noti ce to his address that it is available or it may sneak back up on you in the future. Don't put yourself in that position.
The cost of the locks is small in comparison to sleeping well or feeling safe.
Sorry that it had to come to this but protect yourself.

I would advise you to take some pictures of the damage to your heater, request a copy of all the checks that he paid you from the bank, and open a seperate account in a bank with the balance of his security because these things usually go to court. As long as you have evidence for keeping his security you should be all right.

Second, call the police and make a report that he has your keys and has not returned them, you should know his name and all his information because you're his landlord, so give them to the police.

Third one is an option, you could go to a hardware store and get a knew lock on your door so that he won't be able to get in without force to entering.The lock should be easy to take out and replace, if you need help go on yahoo.com and search the browser there should be picture info on how to change it.

Use a portion of his security deposit to change ALL the locks on ALL the doors. Save ALL the receipts for the re-keying & the repair costs (labor as well) and provide a copy for the past tenant. Keep detailed records of all your communication (i.e. December 2, 2008: 8:04pm Called ___. No answer. Left message re: forwarding address. etc.) Paper talks in court & "you know what" walks. Re-keying of the home should happen ASAP.

Get yourself a Landlord book. Make sure that you do not use the balance of the security deposit. Cut a check for the past tenant, even if you do not know where to mail it to... Keep it in his file. When/If he gets in touch with you for it, you'll already have it. He won't have anything against you saying, "They're witholding my deposit".

Well, you own the house, so right there, you are in full control. Keep the security deposit and change the locks. I know it's a pain in the butt to do, but once the locks get change, that key will be of no use to him.

You need to change the locks and deduct it from the deposit.

You need to mail the security deposit refund and/or accounting within 14 days of the tenant moving out - not within 30 days or 30 days after the keys have been returned and a forwarding address is given. You cannot rewrite the laws. You had better get familiar with your state's landlord tenant laws.

The law does not require that a forwarding address be given - it is advise but not required.

You have to send the accounting to the tenant's last known address - your house. It should get forwarded. It is not silly, it is protecting yourself.

If you do not follow the laws regarding the return of the deposit, you can be sued and the tenant can be awarded double the deposit.
