Island Gurl 79 | Roommate wrote bad checks then disappeared, now he's in hospital. Should I give him some slack? Help!? |
All was fine since he moved in, until he failed to pay August rent, then wrote me a cheque for September from an account he KNEW was closed. He also wanted some cash back so he wrote me a check and I gave him cash. (That was before I knew about the bad checks of course). So now he owes me just over $1300.00.
He disappeared for 4 days and didn't answer my calls. I assumed he was not coming back, even though he left all his clothes here. So he texts me a few days ago saying how ashamed and remorseful he is, and he will correct the situation asap. He said he's getting money from his mom, then he said from a trust fund he was trying to access from his lawyer. (His story changes every day and I haven't seen a dime). Needless to say, he is not going to live with me anymore, but I want and need my money.
Then, last night he kept texting that he desperately needs to talk with me. He will have my money tomorrow, but he is so depressed and needed to talk. I said no, we can talk only when I get the money. The last text I got from him said he was suicidal, so I called him and no answer.
I just got a call from his mother saying he was in the hospital. She wasn't specific, but I'm assuming for being a suicide risk, but he is ok. She said he has the money, but I won't get it for at latest a week from now, for some reason. And then she said he would like his clothes when I get the money.
So yes, I feel bad, but my account is way overdrawn and I have no money for anything! I'm feeling like filing a small claims suit despite all this... but...
Do you think I should go ahead and do that or wait even longer for something that may never pan out? Or cut him some slack? Additional Details There is no lease, but I do have the records of the checks he bounced. I've got pics of his stuff in his room too. |

The guy is trying to screw you out of 1300 bucks and you feel bad? I wish I could afford to feel bad about being forced to lend someone 1300 bucks. You are very lucky to be in such a position.

You got screwed and it was done with intent. He knew exactly what he was doing and didn't care what it did to you. I would call his mother back and say how sorry you are that he isn't doing well but since he has your $ tell him you expect to be paid by and name a day next week. Also tell her that you incurred bank charges because his check bounced and that you expect to be repaid for those too at the same time and say a specific amount and a total. And then tell her that if you don't receive the $ and all of it on that date,you will be going to the attorney general and filing hot check charges against him. It is against the law to write bad checks and local attorney generals handle those sorts of things. That is criminal. And then if you still don't have the $, file in small claims court. That is civil court and ask for all the cash due you plus court costs. They guy is a user and a loser. Sorry if he is suicidal but he may have been in the hospital because he screwed someelse and they didn't take to it too kindly. You don't really know. Be sure to change your locks so that he can't come in without your permission and take his stuff. That suididal stuff is a manipulative trick. He's a con artist. If he was going to off himself, he would be dead. It's his way out. Don't let him get away with it. I would treat him as nice as I would have liked to be treated but stick to your guns. No $, no talk, No $ no clothes or stuff. If you get your $, I would not have anything else to do with him. What a loser. |

You can cut him some slack--to the extent of a week, but not more. . .You can get papers and prepare to sue him in small claims court. . .but you have to pay filing fees and such. . .so get ready, but hold off. . . .don't give him anything else though. . . . .wait the week. . . .He wrote that bad check knowing it was bad and took you for extra cash too--like all the Nigerian schemes popping up on Craig'sList and email.
Giving him a week will make you not feel like a heel, and what's the difference of a week in suing. . . .and if he stiffs you again, you're not in deeper. . . . |

Do not cut him any slack. It is not your fault that he is in the hospital and he owes you money. I think a small claims suit can wait since it would take ages to go through and you need the money now! Do not back down off this guy. You deserve the money and should keep on their ***. Maybe after a week like the mom said you should look into suing. Do you have any proof by the way to show that he owes you money? Such as a lease? |

Sounds like you got itself into a predicament. Definitely file a small claims action. He has been screwing with you I would serve him at the hospital. Is he on the lease? What state do u live in cause there may be laws in regards to him abandoning the lease. there may be other issues as well. |

Set a date to be paid (a week?) and make sure they understand that if it is not taken care of you will turn him into the police and press charges for uttering a worthless check. Then do it.
Don't take on responsibility for his mental problems. You didn't cause them and you can't cure them. |

Do you know his mother? Is she a reliable person? If so, and she says that you will get the money next week (and you can wait that long) I would give him until then. If you take him to court, it will still take a minute for you to get it. If the mom's credentials are not up to par, and you don't trust her word, then I would take it to the judge. Of course you care about his health and mental stability and want him to be okay, but $1300+ is an awful lot of money and too much to play around with. |

You can take the bounced checks to the District Attorney's office. If you don't , someone else will get cheated in the future. Then pay $35 at Small Claims Court and get a judgement for the $1,300. If he pays before the court date, you will accept the money. If he doesn't pay, the judgement will follow him until he pays it.. |

I recently sold a home in New Yor. the people wrote a check for a deposit for 38 thousand dollars. the check bounced ( I incurred lot of fees for this transaction ) the house was sold as is, and the peoples explanation is they changed their mind about purchase. the contract clearly states that if they change their mind they lose their deposit. do I have legal recource. |
