Scam or not?
This investor says he can help me sale my house by lease w/ option to buy to a person with bad credit. All I have to do is put the title or deed in his or her name until their credit is better, then in 18 months they will get a loan and buy it.. It's a scam. NEVER put anything you own in someone else's name. If you do this before they've gotten a loan, then it's theirs to keep. You can do a lease w/ option. However, they have to sign a lease w/ you, just like any other tenant would. After, they've signed a lease, then they should sign a SEPERATE agreement called a lease option. If they plan on purchasing your property in 18months, then you are acting as the bank for 18months and are basically promising not to sell you property to anyone else....for this, ALWAYS require them to give you at least 3% NON-REFUNDABLE deposit. Whatever you do, have an attorney look at all documents so you won't get caught in a scam. Don't sign anything until you have a Real Estate attorney on your side.

SCAM. If the person has bad credit already, then they are way more likely to default on the house payments. So you're letting them live in your house while you still own it, and YOU still carry all the risk and trouble if the payments aren't made.

You'd be better off just renting the house and being a landlord - you'd have more rights, and be able to evict them for non-payment much faster and easier.

Tell the investor you only want to sell the house outright to him; how he leases or rents it after that is none of your concern, but you don't want to be trapped in some odd half-owned quagmire.

Just like in the sale of a car, never put someone else's name on a title until you have received full compensation for the cost of the item for sale. When you do, it becomes their possesion, and as they say, Possession is 9/10ths of the law. If you do want to do a lease with an option to buy, then do exactly that. If the investor wants to pay you for the house, then put his name on the title AFTER he has fully reimbursed you. Otherwise, you just gave away your home....

Yes, it's a scam, and a doozy of one. If you put the title of your house in ANYONE else's name, you've basically given them the house. They can legally sell it, rent it out, tear it down, or do whatever they want with it. What's worse, if you do this without an extremely clear contract (or even with one), if you enter the house again for any reason, you can be arrested for breaking and entering. Also, if they don't pay and you try to evict them, the house is in their name and you could end up losing it to them.

It's really not a good idea to try to "get around" bad credit like this. If someone's credit is bad, it's usually bad for a reason. If the house isn't selling, there are other options besides doing something that will probably make you get nothing for it.
