Security deposit for apartment...?
My landlord is trying to keep my security deposit because we ae moving out 5 months early but in our lease it says at the termination of tendancy the security deposit will be used for any necessary repairs or accrued rent. We do owe one months rent. So shouldnt it be used for our owed rent instead of because we just moved out early?

I'm not asking for any money back. I'm just going by what my lease says.

Technically you owe him for the 5 months since you signed an agreement to pay for them. I would not give you your deposit back.

Hi,
Security money is NOT rent money. When will you tenents get that straight!? Your Landlord has every right to keep your deposit if you broke your lease...what do you think a lease is for anyway? The termination of the lease you speak of is the end of the lease...Not an early termination (breaking) like you are doing.

Guess what ? Your accrued rent will amount to those five months worth if you terminate your lease early. Read the language of the lease much more closely.

You can expect a small claims action to recover your unpaid rents, plus any expenses to repair any damages caused by you.

no ,you already owe him a months rent,plus he could take you to small claims court for breaking your lease,if he cant rent it he looses money because you left,let him keep the deposit,and count your blessings he doesnt want more,also pay him for the month you owe

The termination of tenentcy occures at the dated end of the lease. You are breaking the lease. For that, you need the landlord to agree (in writing). If he does agree, then the security deposit will be used for any damages or accrued owed rent/rents. If he doesn't agree, then he can obtain a court order (in housing court) enforcing the lease to it's fullest. That means you might be responsible for the rent remaining on the lease.

Honestly, a lease is a contract that says that you are responsible for the entire rent for the period of time that is on the lease.
The purpose of the security deposit is not only to be used for repairs, but is also a guarantee that you will not skip out on the lease early (which is what you are doing.)
Sorry to say this, but he has every right to keep the deposit and ask for the extra month's rent. (he could sue you for the entire 5 months of rent if he wanted to.) If you don't want to lose the deposit I suggest that you sublease the apartment out to someone for the remainder of the lease.

yes. typically the security deposit is for any damage, but can be kept if you terminate the lease early. Most of the time, they charge you a % for all months you left early.... you got out good! :)

Well i went thru the same thing were i lived ,and i broke the lease early , my land lord tried to keep my deposit as long as you move out within the leave the property in the shape it was in when you rented they have to by law return your deposit if not i would suggest going to small claims or even contacting renters rights for list of right and responsibilitys

Read your lease again. I'm sure it reads more like...upon completion of tenancy, security deposit will be used...blah blah blah.

What lease?....you've already broken your lease by skipping out 5month early.

Either way, your liable for the 5 months of rent or until the apartment can be re-rented.

Using the information that you gave, your deposit will be used for the one months back rent you owe plus the 5 months remaining on your lease plus wear and tear and cleaning of the apartment after you move out. You probably won't get any money back.

i believe it should as long as there isnt any damages to the unit, if i were you id take pictures so he or she cant say you did damages to the unit

you will have to pay the landlord money that is owed for any damages that are beyond normal wear and tear plus any unpaid rent. Lets say that your lease is up in May and you move out Jan 1st. If the apt doesnt get re-rented until feb 1st then you will still owe for that month because your lease doesnt expire until may. Unless your lease says alls you need is a 30 day notice. The landlord cannot charge you more than 3 months of rent though.
