In your tenancy agreement, it should spell that the landlord shall refund the deposit within X number of days after handover. Check this out.
Also tell him you need the money for whatever reason you can give, e.g. pay for the deposit of your next unit, lots of bills to settle... |

By law, your deposit should have been placed into a separate account that your landlord should not have been able to touch. Check your lease for when he must return this money. |

Your landlord cannot use your deposit for anything other than returning the rental unit to the same condition as when you moved in, or non-payment of rent. To do so is illegal.
Your lease should state how many days he has to return your security deposit after it expires. If not, or if you do not have a lease, it defaults to state law, which is usually 30 days, but depending on what state you live in, can be anywhere from 14-45 days. Research laws for your particular state. Returning a deposit once a new tenant found is NOT the law.
If your landlord does not return your deposit on time, you must write a demand letter saying that it is overdue and he has, say, 14 days to return it. In some states, the landlord automatically forfeits his right to withold any portion of the deposit once it is late, so be sure to ask for the FULL refund of your deposit.
If he still does not return it on time, you may sue him in small claims court for up to three times the amount in some states. However, even if you win the case (which you probably will, barring any other pertinent info you might not have shared), it does not automatically mean you will actually get paid. If your landlord does not have the money to repay you, the court can garnish his wages and place liens on him, but if he has no wages to garnish or no loans to lien, than you are SOL. |
