Security deposit lost. What I can do?
I moved out of the previous address and the landlord unreasonably took all my deposit into his own pocket, not a single penny returned. The money is more than 1000 dollars. What I can do? Since I moved out of the state, and very difficult to come back to the old state to settle in small claim court. I am not sure how to pursue next. Thanks for any input!

I suggest you read your lease very carefully. There are ways for landlords to word things just in a way to benefit them and NOT the tenant. If, in your lease, the "security deposit" was worded as a "security fee", there's nothing you can do. If it was worded as a "security deposit", you might have to take him to court or hire a lawyer in that state to mediate the situation. Look at http://www.findlaw.com under the real estate section. There may be some useful information there for you.

I have alot of experience in property rental management laws. What I suggest is to write a letter to the landlord threatening a lawsuit if they do not return the just amount of the deposit. Make sure you send it certified and keep a copy for your self. Find out some of the rental laws in your state and use those terms in your letter. If he does not respond or make payment, the only other thing is small claims. I'm afraid that is the only other alternative in your situation.

Unless you are willing to take him to small claims court there is nothing else you can do. The advice to call the police is comical! They have no authority to take your word over his and will do nothing without a court order.

If you genuinely believe you are in the right, and would have no reason for your landlord to take your security deposit (no unpaid rent, cleaning charges, etc.) you can take them to small claims court for "double damages". Although it would be a pain because you are in a different state, double damages means if the landlord is found in the wrong- you collect double, up to $2000. Just something to think about...

Trying to get it back will be more trouble than its worth. It would probably involve small claims court and all. Not worth it, just let it go and count it as a lesson learned.

chalk it up to a life lesson. You rarely get your deposit back and if small claims court is too tough for you to swing out of state theres not much you can do

well either keep calling and harassing him to repay your deposit or take him to smalls claims, other than that theirs not much else can do.

It all depends on when your lease was supposed to be up! If you left before the end of your lease its going to be tough to get any of your deposit back. You guys entered into a contract and if you did not hold up your end of the bargain you will be deemed as being in default. Now if the landlord unfairly took your deposit after you fulfilled your end of the contract by staying in the home and not leaving any major damages behind, he has to return your deposit. Now I'm not an attorney but the best way to go about it is hire one to write a demand letter and give him 2 weeks to return your deposit and see what happens next. Good Luck

You could ask a lawyer to write a letter for you demanding your money back. It would help if you have records showing proof of paid rent and pictures showing the condition of the property when you left. If you don't have these things, the landlord can say you left owing rent or left the place in bad condition. If you can't disprove any assertions he might make, you should probably just forget it.

Find out if the law in your prior state provides for attorney fees in the event of a wrongfully withheld deposit. If it does, simply hire an attorney to go to small claims court for you. If you win, they pay the attorney fees. You may be able to win without showing up if they do not provide proper documentation to show the withholding of the deposit.

Send him a certified letter, demanding repayment, or a written explanation as to why the deposit is being held. Carbon copy the Attorney General of the state. If you get no response, you can threaten to file charges with the local police department for grand larceny. Usually a visit from the police loosens the wallet quickly.
By the way, many states require that a security deposit must be held in an escrow account, and that all of the interest on the deposit be given to the renter.
