This is why a good Real Estate agent does a "final walk-through" prior to closing. In other words, say an hour before the closing, your agent meets you at the subject property to inspect it, make sure it's not flooded etc.
However, as others have stated, if there's no requirement of cleanliness in the contract, it might be a problem you have to live with with no recourse. Live and learn. |

When I closed on my house me and my agent did a quick walk through of the house and it was a mess. There was rotten food in the fridge and trash all over the back yard. The toilet and bathroom were disgusting. I had the option to refuse to close. Since you closed already the sellers may not be liable since you have signed and it's not in the contract.
Your agent, who you trusted to do what you hired him to do on your behalf holds some blame. I think you have a case to demand reimbursement from him. If he refuses, contact your local realtor board and the local governing agency and raise hell! Also tell everyone you know about what happened. Realtors really rely on word-of-mouth and you have an experience that would make other buyers think twice about his reliability. |

You could ask them to pay it. If they refuse then take them to small claims court. I doubt you will win though and the time and hassle involved may not be worth the $200. It is not like an apartment where you can take away their deposit. The deal is done and it was for a house. Unless you specified in the contract that you wanted them to clean the house before you got it then you are pretty much out of luck. |

When I closed on my house I did a walk through with my agent a couple of hours before signing the papers. This could have been settled before the closing by them placing cleaning money in an escrow account that way if it wasn't clean to your satisfaction the money would have been there for you to hire a cleaner... |

depends on whats in your contract. If there is nothing in writing about the "2 days" or the messy house you are SOL. If there was something documented about the situation then you are in luck. I hope you took photos of the mess before anything was cleaned. |

Nope. You should have held money in escrow to assure that they cleaned it or to hire someone to do it. |

Not if the agreement didn't say that they were responsible for the cleaning. If so you can take them to small claims for the amount that you had to pay the cleaners. Better have receipts or checks with you though. |

Normally RE contracts call for a house to be "broom swept/clean", which can mean different things to different people.
If real cleanliness was important to you, your agent should have included in the contract to ask for "professional cleaning", with receipts to be provided after closing and funds to be held in escrow, with the release of funds after your approval of the work.
Your agent did sloppy work for not quizzing you enough about your cleanliness standards. As your agent, I'd give you the $200. |

Your agent didn't inspect, so tell his broker. He ought to make the agent pay and learn a valuable lesson. Go in person, be calm, and let the broker know how disappointed you are with the lack of professionalism.

The normal procedure is that an escrow is held by the attorney attorney about $500.00 or so money in escrow in his account until the realtor told him the house was clean. I think the realtor should cough up the money, because it was a mistake. |

If you don't like to clean up nasty messes I can only imagine what it will look like in six months. Maybe what you can do is learn how to clean up messes. |
