Selling a house with ghosts?
If I am selling a house, should I disclose to the realtor that there are ghosts? If I do, it might not get sold. If I dont, the new owners might complain later. Can they take me to court if they see the ghosts but I didnt tell them about it beforehand? Thanks for all who can help.

It depends on the state you live in. There is a case in New York where a buyer wanted out of a house because he found out the seller had been telling people that the hosue was haunted prior to selling it but did not disclose it to the buyer.

So to be on the safe side you should either disclose it if you've already told people or if you have told no one then tell no one else and don't mention it.

You don't have to disclose ghosts, as they are not a structural defect in the home.

You have to disclose structural defects that you know about. So, if the ghosts thrash the central A/C system, you have to report that the central A/C system is busted.

Well, I believe 'ghosts' are just memories that come into our range of vision. Unless you've seen them with YOUR own eyes, I wouldn't mention it!

Well, depends on if you believe in ghosts. Umm, if you don't, then you don't have anything to disclose, right. Hint, hint.

But, I do believe that you are obligated (although not necessarily legally required) to disclose things like that if you truly believe it to be a problem. Maybe not on the disclosure statement itself.

However, if they ask, you have to tell them the truth. But then again, what ghosts? I don't believe in ghosts. Hint, hint.

Be honest about it. "Ghosts" don't usually turn people away from buying a house. If you're honest about that then a buyer would feel better about buying your home because of your honesty. No, it's not a law that you have to disclose that but it's a good idea.

some people are really into ghost .... if they tried to take you to court just say the ghost where never there when i lived there ....but i am not sure if they can take you to court for that

Well, personally, I wouldn't say anything. The new owners can't prove that you knew there were ghosts in there.

In most cases regardless if someone believes in ghosts or not...they will not talk about it. There are no legal risks of disclosure on real estate transactions that are even close to this topic.

Good question. It could make an interesting court case. You should consult a lawyer. There was a case I read about in the US where the judge found that it was the seller's duty to tell the prospective buyer that the house was "stigmatized".

Of course, some people don't believe in ghosts and it wouldn't be a problem for them. (Until...)

Other people actually like ghosts.

I wouldn't say a thing. If they find out later that there are ghosts then let them handle it, they bought the house.

Up to a few years ago we here in Florida had to disclose ghosts, murders, suicides in a property if we knew about it. My son (10 years old at that time) thought that was funny and he made business cards up on his computer as "Ghost Busters" so if i am selling a house with a Ghost, he said he can make some money as a Ghost Buster.
They changed the law. Now we don't have to offer or disclose the information but if the potential buyer asks, we have to truthfully answer this questions.

In Indiana, that is something that a Realtor can specifically not disclose. How do you prove something like that? Ghosts don't exist, and it would put a stigma on the house where none should exist.

Ghosts can not be proven. They are not a "material fact" about the house. Realtor here.
