Selling your home?
I am trying to sell my home by myself but I have no idea what to do in regards to paperwork, deeds or titles. If I do have a buyer, who would I go to when they get the approval from the bank. Do I just call my mortgage company and say that I sold the house and this is the new owner or what. Im so worried that I am gonna have to get a realtor and lose that 6%.

Good morning. When selling your home on your own the biggest problem that many sellers face is getting people to the house to become interested. Marketing and time do not favor "for sale by owner's". To sell your home you will need to obtain a purchase agreement, property disclosures and you may want to put together some flyers with information about your home and place them in an infotube outside of your home. This will not only provide people who drive by with information about your home but it will indicate how many people are stopping by to grab a flyer and may have some interest.
Once you have a buyer and you both agree on a selling price everyone will sign the purchase agreement and you will contact the title/escrow company (could be an attorney too)that you want to do the title work. The title/escrow company will handle the title work and the distributions of all of the money to you, your mortgage company, the buyer, the new mortgage company for the buyer, etc....
If you are really unsure of what you are doing you may want to contact a real estate attorney and have them draw up a purchase agreement and give you a little guidance. They should be able to do this for fairly cheap and it will still save you a ton from the Realtor's fee. There are alos company's like NextHome that you can obtain some of this information from along with the proper forms and some guidance. Check out the links in the sources for more information about "for sale by owner," commonly referred to as FSBO.

You can get an attorney specializing in real estate cheaper than the 6% a realtor would get. The attorney can handle all the closing details.

Go to a local title company. They can help you when you are doign for sale by owner transactions. They can guide you to the right paper work you need to get and they will also do all your title work once you get a buyer.

Also.. nexthome is good to use they supply you with everything for $995. Little less work for you and you get a better marketing of you home.

I am a Realtor, and honestly, if you are stumped at these very basic steps in a transaction, you are probably in WAY over your head.

Why are you "so worried" about paying a Realtor? If you hire a Realtor, they pay for advertising, they put the house on websites, they handle the calls, they make the flyers, they hold the open houses, they field the problems, they take care of everything.

Try to sell it yourself, but set a time limit and a budget. 80% of FSBO end up going to a Realtor, so don't waste alot of time and resources doing so.

The best thing would be for you to use a Realtor and try to negotiate a lower commission rate. You should be able to find someone who will work with you. Just figure out how much you can afford to pay in commission and see who will work with you.

On the other hand if you go the For Sale By Owner Route. The first thing you need to do is get a good solid contract. Then if your state has title or escrow companies use them to do the title work and your closing, that way you let them worry about pulling the deeds and title. If your state does not use title companies then use a closing attorney. Next call you mortgage company and request a pay off so that you know exactly what you owe. The title company may do this for you, but it wouldn't hurt for you to have one as well.

The only other thing is you want to make sure you keep in constant contact with the buyers to make sure that their loan is going OK so that you won't have any surprises towards closing.

If this seems like a lot of work to get your house sold successfully, it is. If you work a full time job I would suggest you try to use an agent. Good luck to you.

It can be very complicated when your doing it yourself, but not impossible. Your best bet would be to contact an attorney and have them draw up a contract when you get an offer. They will know everything you'll need to do and can get you any other papers you will need to have signed (there are disclosure forms that will need to be signed). Get an earnest money deposit from the buyer and have the terms you and the buyer agree to put into the contact. The attorney can guide you in what needs to be included in the contract. They buyers may have to get financing, and when they get approved by their lender for closing you will have to furnish title insurance. You can order it yourself from a local title company, or have the attorney order it. A closing will be done at either your title company or attorneys office. You can have the attorney draw up your deed as well. If you can sell without a Realtor you will save money, but I would invest in the attorney just to make sure you are covered on all fronts. I've sold all my homes by myself and afert the first one it was pretty easy. Good Luck.

I know this is not what you want to hear but get a realtor. It is so much easier in the long run and maybe the realtor can get you more for your house and you will not be out the 6% you think you will be now. Also this isn't a good time for real estate so call around and negotiate a lower rate than 6%. In this area there are some at 3%...doesn't hurt to ask. They want your business.
That said. There are agencies that help people in this situation. Look for citizens advocacy groups, free home owners seminars, ask at your local bank, there is something called docu pros (places that will do a document for you) and I bet you could find a purchase and sale agreement on line.
Also check with your city/towns registry of deeds office and see if they can help you.

One thing to keep in mind on a For Sale By Owner is that often times bargin hunting buyers are attracted. They understand that you are not paying a Realtor's commission and what to use that fact to negotiate for a lower price. Remember that when you employ a Realtor to list your home you have a trained and experienced negotiator on your side.

Many of the people who contact you when you try to sell your home "For Sale By Owner" are individuals or companies that advertise "we pay cash for your home". You will prepare your home for the showing, walk them through while they thouroughly examine your home, then they will make you an offer that is 20% to 30% below market value for your home.

To price your home appropriately, find a real estate agent who is experienced and professional. Ask for a Comparative Market Analysis for your home. Inform him or her upfront that you intend to try to sell your home yourself. Make an unwritten agreement that if you cannot sell your home by yourself, you will hire him or her as your listing agent. Most real estate agents will glady perform a Comparative Market Analysis under those circumstances, because you have sincerely offered the possibility that you will employ them at a future date.

Many FSBOs enlist the assistance of a mortgage broker to help advertise their property and screen any interested potential buyers. This allows the mortgage broker to pre-qualify any potential buyers so the homeowner does not have to waste time with buyers who cannot afford the property.

Well over half of the consumers who try to sell their home for sale by owner end up utilizing the services of a realtor. For Sale By Owner can be a very time consuming and daunting task. You must market your home, print up advertising flyers and/or brochures, make time for open houses, set up appointments for people to come look at your house, have all of the appropriate disclosures that are required by law, have a purchase agreement signed, arrange for title services and set up your closing with the title company among many other things. Therefore, be prepared to have to put some time into selling your home by yourself and realize there is more to it than just putting a for sale sign in your front yard.
