Adam | Should I require my new tenant to get renter's insurance? |
I'm renting out my house for the first time. Should I put in the lease that I recommend they get renter's insurance, or should I require it? I'm not sure if that will scare them off. I already chose on the tenant and we are signing the lease later today. We have not talked about renters insurance before, and I just realized that today. Additional Details I live in California. Does anyone know if it's illegal to make it mandatory, I don't htink it is here. Also, I am meeting them today to sign the docs, it's too late to require them to show me proof but maybe if it's on the lease it might protect me more? |

I would DEMAND it. There is NO reason that they shouldn't have insurance - unless they can't pay for it. In which case, you don't need or want them as a renter. Renters insurance is cheap. Less then 100 bucks a year.
Just put it in the lease and don't give the keys until they provide you with a policy binder and receipt that they paid.
Require that they give you a yearly update on the insurance. |

You are probably safe if you say something in the lease that the tenant's items are not your responsibility nor are they covered by your insurance, and recommend that the tenant carry renter's insurance.
However, if I was renting out my house, I wouldn't accept "probably safe." I would demand "guaranteed safe"
Its very normal to demand renter's insurance and require proof. I suggest you require that they show proof of payment, and even make the lease void if the renter's insurance policy ever expires. Make them show proof of payment each time the previous payment period is about to expire. For example if they prepay for 6 months, then demand to see proof of payment again in 6 months.
Another option is to just put it in the lease that they have to pay an extra $20/month toward the cost of renter's insurance. Then you buy a policy for them and make sure the payments are kept up to date. |

Depending on the laws in your state, I'm not sure you can require them to get renters insurance. I would write and print out a statement to the effect that you discussed with them the benefits of getting renter's insurance and that you are not responsible for any losses to their property. You both can sign it and you can give them a copy as well. |

You should absolutely require it.
There may be instances outside of your control like "acts of god" especially in California where you are no stranger to the occasional natural disaster.
Certainly you have your property covered, however tenants tend neglect to cover their possessions, and in the case that the home is for some reason damaged along with some of it's contents you do not want your renters trying to sue you (even if it is outside of your control) |

A strategy that we have used in our lease is that tenant insurance must be provided and kept in force before they get the keys. Think about it- who has more dollars if there was ever a loss- the tenant or the insurance company! It is very affordable and its asset protection for the tenant and the landlord. For only a few dollars a month, even if you pay them back you are way better off having them obtain it.

Of course, you can put it in the lease and they can cancel it after they sign it. You won't find out until they burn the house down, right?

Renter's insurance covers the renter's property. There's no benefit to you. I can't see how requiring it would serve any purpose.
You should always reccomend it to your renters though. |

I believe renters insurance does not cover any parts of the building. It only covers the tenants property within the house plus liability if someone is injured while in his apartment due to his negligence. I'm not positive but I don't think there would be any benefit to you as the landlord so there's probably no point in requiring the tenant to have it. You should probably check with your insurance agent in case your states laws are different. |
