A young lady has advertised for a flat. She is pregnant and will claim housing benefit. She revealed, however, that she has a partner who works and that she is also working part-time. Will they really be eligible for Housing Benefit? She says her stepfather will act as a guarantor. I am meeting the couple for a viewing of my flat Thursday night. I am thinking of asking for a photocopy of their passports to prove they are who they say they are, references from their employers and insisting that a standing order for the rent is attached to the guarantor's bank account not theirs. Is this reasonable? |

Hi I work for benefits, I think it would be unlikely that they would qualify for any Housing Benefit until the baby is born. Even if they do qualify for help, if they don't give you the rent you can ask for the money to go directly to youbut they would have to have at least 8 weeks , normally the money would go directly to the tenant this is for tanats renting from a priviate landlord who is not a registered social landlord arrears. At the end of the day she is being honest and up front with you which shows she is reliable. I don't think it is unreasonable for you to ask for payments by standing order, but what I would say if you are going to do this is to include these terms in the tenancy agreement, also to attache the standing order to the guarantors bank account will be an inconvenience for them, I would attach it to the tenants account then go for the guarantors if things go wrong.
If I were you I would advise them to check to see if they would be entitled to benefit first, you don't want them moving in thinking they will get more money if they do not qualify, they can contact their local council who will be able to give them a benefit estimate over the phone. You used to be able to get a pre tenancy determination which would advise you what the maximum benefit is you could claim, these are now obsolite with the introduction of local housing allowance which is paid at a flat rate |

They may be eligible for some housing benefit (its actually called Local Housing allowance now) even if both of them are working depending on their income. With a guarantor you dont need to necessarily have the money coming out of his account, it may be a little unreasonable to ask that, since if they dont pay he is liable for the rent anyway. You can ask for references from their employers ie to prove they are in employment, thats reasonable, and I guess a copy of some ID would be useful to prove their identity which is normal for a lot of situations.
The benefit is actually paid to the tenant not direct to you unless the tenant can prove she is vulnerable or has had trouble paying rent in the past. |

It seems she was upfront with you in the first place. It is possible to be in work and still qualify for Housing Benefit. However, Housing benefit seldom covers the full amount of a private rent. A claimant can get a 'pre rental determination' from the local authority prior to signing the lease that will detail how much of the rent they will pay as Housing benefit, the shortfall they will have to meet themselves. I personally would check that they will be able to meet the full rent, they may be under the impression the council will just pay it all, which certainly isn't the case. Why not ask then to get a prerental determination to ensure they are in a position to meet the costs.

it is very unlikely that these prospective tennants will be able to claim housing benefit as their working hours would be combined when they make the application, as most part time jobs are over 16 hours a week - you can probably see that this would be almost equal to a full time job and as such would disqualify them from HB. also HB can be paid directly to the tennant but councils usually prefer to pay directly to landlord. I would also check out the stepfather, a standing order could be cancelled by him at any time. Personally i would avoid prospective tennants on any benefits as they are usually unreliable and do not treat the dwelling in a decent manner. |

if she has a guarantor, then surely that is enough?
besides, even if the standing order initially comes from the guarantor's bank account, there's no reason why they couldn't change bank accounts to pay the rent.
i think with the requirements that you have stated, the prospective tenant may well just go to someone else to rent a flat. |

I think you will find the partner doesn't want his name on the rent book. If that happens, they are eligible for full council tax and that will effect any housing benefit.
The rent would be paid directly to you, however you would be committing fraud if you know the claim isn't genuine. She will not be working part time for much longer. Are you asking for a deposit? If you want her stepfather or anybody else as a guarantor you require a legally binding contract.
If you think the deal is iffy before you sign the paper work, the only advice can be walk away and put no DHSS on the next time you advertise the vacancy. |

Housing Benefit is paid directly to the Landlord and not to the tennant. I would however insist on the standing order though. |
