Write to the lender and ask if you can rent the repossed property from them. They won't want an empty property back which they can't sell or make any money from.
They have a decent chance of selling the property with you as an existing tenant, to an investor or investment institution.
Better to do something, and perhaps be wrong - than to do nothing and wish you had acted. |

No a landlord shouldn't but everybody gets into trouble at some time or another. Your rights are the same as they would be if you were leaving by your own accord or because the landlord asked you too. You will still receive 2 months notice and get back any deposit you payed. You won't be able to stay living there though as the house would be owned by the mortgage company or bank. They will be looking to sell the property to make back some of the money they have lost, so though your upset you need to start looking for somewhere else to live otherwise you'll have homelessness to contend with too. |

I sure would be upset. Some owners rent or lease to make the payments. It sounds like in this case, the person was taking the money and running. |

No of course he shouldnt but there are many landlords who would do this. As far as your tennancy is concerned, the mortgage company would have to follow the law on getting you out ie, two months notice, court order etc. They can't just send bailiffs round to evict you so don't panic. You've probably got at least 4 months to find somewhere else. If you are unemployed or on benefits, now is the time to sign on to the council housing list and let them know the situation. The Private Tennant's Department will give you advice and guide you through the next few months. Just remember, do not leave with nowhere to go or you can find yourself intentionally homeless and get no help. At the moment, none of this is your fault and the Council just might help you. |

Yes I would be. Unfortunately unless the landlord can make a settlement payment it would appear you are about to be evicted. This is the responsibility of the landlord to correct which means it leaves you the tenant powerless. You can wait for them to serve notice of eviction on you, as this should only happen once the repossession has been approved, but I would start looking for a new place to live and leave, there should be an eventuality in your agreement that covers failure to pay charges pertaining to the property that are not the tenant's responsibility.
Even if they do make a payment, if they miss another then the process will only start all over again. |

Sounds as if LL is in trouble, and was trying to make money by renting out. Unlike other posters (friend of a lawyer) you were perfectly entitled to open a letter as it was NOT addresses to LL but to occupier. Do not pay any further rent, keep in separate account, write to LL to say you will be withholding rent until the situation has been sorted out, as you have a duty to your family and their situation, and he has rented the property under false pretences.

Yes, this is wrong, but why would the lender address letters to the occupier and not the borrower? I think you have been opeing letters not addressed to you.
If the house is repossessed, you will be evicted and the house will be sent to auction. Lenders have no responsibility to you and will only want to be able to cover the loan as soon as possible. |
