Should i demand to see the lease before giving the rent?
I have a new apt that i have paid the deposit for but when i went to pay the first month's rent I expected to see a lease agreement (1 year lease) and they didn't have anything for me and said that the owner would send it later. so is it correct for me to wait until i see the lease before i give them more money?? i should see what i'm signing for right? This just seems unprofessional.

i did give the deposit to hold the apt but they cashed it right away. i then was given a key which opened the apt but now the key doesn't work. kind of weird and now i wish i hadn't even given the deposit since it was 995! but i will not give anymore money until i see and sign a lease...

You absolutely should have received a lease to sign at this point. Check your state's tenant rights laws online, but I'm guessing this is a pretty basic requirement. After all, it really protects both parties. Once you sign it, request a copy of that signed version within five business days. Good luck!

You may also consider contacting your local tenant rights organization for advice. This seems really fishy to me.

DO NOT GIVE THEM ANY MONEY! That is not right. Tell them you would be more than happy to wire it to them or send them a check as soon as you are able to review the lease.

If they give you a problem, tell them you have a legal right to read the lease agreement before you enter the contract.

Yes, you should not be giving them any more money until you know exactly the terms of the agreement. It is rather odd that THEY would not be demanding a signature. I would be leery.

You are entitled to a lease agreement. Yes, it is unprofessional. Contact your states Real Estate Commission to find out steps you can do to ensure that you do indeed receive one.

You should have been given the lease at the time of the deposit. I would try contacting the owner/lessor and find out exactly what is going on before handing over any more money. You indicated that the key does not work anymore? Is that still the case? Are you sure the person who leased you the place is authorized to lease it? Sorry for asking you more questions, but you need to find out. Did you get a receipt for the $995 that you gave them? You definitely need to know what you are signing.

You shouldn't have paid ANY money, before seeing a lease.

It's not only unprofessional. It's illegal.

To rent an apartment, you want to sign a lease before you move in. Otherwise, you have no legal right to reside in the apartment, they could kick you out tomorrow, and keep your money. The owner can't send a lease later, because it's not a legal contract, unless you both sign it. Something is definitely fishy about this situation, and you're right to be suspicious.

As it stands now, you've paid someone money, with nothing to show what it was for. Lacking a receipt, that makes it a gift. You don't even know for sure if the person you paid legally represents the property owner.

Don't pay any more money, unless you're offered a lease (contract) that specifies what you're getting for your money, and for how long, and you're absolutely certain the property owner signed it.

If I were you, I'd go to the local tax collection office, and look up the owner of the property. If the name doesn't match up, I'd go to police to ask them to find out if everything is on the up-and-up. You could always write a letter, or place a phone call, to the property owner (listed on tax records.)

You certainly are entitled to a signed copy of the lease before you owe any money.

"Did you get a copy of the signed rental agreement? The landlord is required to give you a copy of the rental agreement, and it is best to get the copy in person at the time you sign it. If there is any later dispute, the first thing you need is the agreement. If you lose your copy of the lease, you may request that the landlord make you a copy."
