Should i go or should i stay put and let my landlord take me to court?
Advise wanted please,. Due to the failer of my landlord not carrying out vital repairs in the flat i rent from him. Which are causing me serious health problems... I have been to cab and my council. Now my landlord has given me notice, but am advised to stay put and let him take me to court.. Has anyone else been in this position, and what will it invole. Should i be worried about this. I think you have to stay put and let him take you to court.... The council will not help you unless you have these vital pieces of paper from the court... i am having the same kinda trouble with my landlord... They are a law unto themselves, as soon as you have the notice from your landlord, go back to the council and they will be able to help you out... Good luck it is so stressful when things like this happen.

firstly, why would you want to stay in a flat if you are getting health problems? surely your health is far more important than that!!
secondly, why has he not done the work that is required? is it structural and does he need you out of there to get the work carried out.
why dont you offer to get the work that is needed carried out and then deduct it out of the rent? as a landlord i would get it sorted but if i was short on time and the offer came in for the tenant to get it done instead of paying me the rent then so be it. Either way its me thats going to be paying in the long run.
If he does take you to court he will be advised to get the problem sorted under the tenency agreement. So you need not worry about going to court. How long do you have left on your lease? is it worth all the hassle?
Good luck what ever you decide is the best course of action.

If all the relevant procedures were done and the C.A.B are satisfied with your own actions, i would agree with the majority, stay put.

My brother was privately renting a flat and a crack appeared in the ceiling. He informed the landlord on numerous occasions that it needed to be looked at, keeping a copy of each correspondence.

He went away for a couple of days only to return with a caved in ceiling and a home full of damaged clothes etc which cost him a bit to rectify.

The landlord relocated him whilst repairs were being made but prior to him moving back the council offered him a place which he snapped up.

During this time he stopped paying his rent and didn´t pay up when he left. The landlord then went to his work place demanding his money or court action would follow. My brother informed him that he would get his money when he received his for the damages incurred because of his negligence. And if he wanted to take it to court then do so, as he had copies of all correspondences sent to him. Of course he heard nothing afterwards.

stay where you are. i presume that environmental health have got involved. it is illegal for him to give notice after receiving a notice for repairs. so let him take you to court. he'll be hit with a monster fine. i had the same thing. but we managed to work it out amicably. just keep paying the rent on time, clear any arrears you may have and seek proper legal advice. he's not allowed to do it.

From the other side.....

You are going to have to prove that the repairs are a serious health issue. There are VERY few that qualify. Mold does, but not mildew, and it is only a few specific molds.

After proving that there is a "serious health problem" you have to prove that the landlord is responsible (easy to do that one). The fact that you are staying works in your landlords favor though, if you were all that concerned about your health you would either fix the problem yourself or you would move out.

You are also going to have to prove that his request for you to move was not in order to do the repairs reported to him. If there really is mold the walls and flooring may very well need to be removed, which can't be done with you there.

if the council told you to let him put you in court i would infact let him do it.
they know best and i would stick to what they say.
and in the event you lose the flat, you then tell the council they gave you wrong advise which you followed and tell them to re home you or you will go to the press

You need to get in touch with a solicitor who deals with housing problems. Also find out from the library the organisations that help people like yourself who rent private.
Good luck. Don't move at any cost.

stay put, he or she will not get you out for up to three years,
if your health is affected by this. you will need a doctors note. keep all record of doctors appointments, and any other relating letters or notes.

Get in touch with your city health department and have them come out and survey your home. If they concur what you say, you can TAKE YOUR LANDLORD TO COURT.

Stay put , and contest the action

You have been advised by your Council / CAB to stay put , as if you leave , by law you make yourself homeless , and they will not be able to help you

Your landlord reminds me of an ex landlord of mine , he claimed that I did this , that and the other , but when I confronted him , he backed down
