Should i pay all my rent?
okay i have lived at my current residence for a little over 2 years. i rent from an individual, not a company, he has 7 trailers here and more somewhere else. my landlord works with people on payments, as a matter of fact he worked with us on our deposit when we moved in. he also takes pretty good care of his rental properties. we have a big yard and a playground. we have had a few problems with our door not closing it took 6 months to fix. septic tank backing up which also took 6 months to fix and is messing up again. mold under our sink that took 3-4 months to get him to fix. he always fixes stuff but the longer we live here the longer he takes to fix things. other resedents have told me they have had similar problems. he always says he is busy cause he owns a remodeling company and that is why it takes so long for him to get out to fix stuff. so i try not to bother him unless it is something big. so here is my problem about 4 months ago he was taking the dishwasher out vcause of the mold behind it and while doing that he did something that lost us power to half of the kitchen and half of the living room. but about a month ago the power to my childrens room and the only bathroom we have went out. he finally came to look at it 2 days ago and said he coldn't figure out what was wrong so he would have to get someone else out to help him. i dpn't know how long this will take plus my kids can't play in there room, and it is hard to poty train in the dark and shower in the dark. you get the picture. plus i bought those handi lights you can stick up anywhere they run on batteries which was $40 for 4 but they are not bright enough to light up the whole room. i pay $450/month rent would it be wrong to ask for$100 off this months rent?

i didn't say i wasn't going to pay i was just thinking about asking for $50-$100 off of the rent. and just to clarrify my landlord works with everyone he is not a bad guy.

Technically your landlord has to provide the basic living standards, which include electricity, heat, sewer, and cooking ability. You can withhold rent if the house is not habitable.

Before you get excited, the definition of uninhabitable is not a few lights not working, and you can't withhold rent just because he didn't fix it right away. Ultimately you can hold back payment of rent if you had to pay for a repair that was an emergency or requirement to make the home habitable and provide receipts to prove it. He can still evict you for non-payment and you'd have to have a paper trail of problems, times, and payments to hold up in court.

It's great that he fixes things, but the timing you mention is inappropriate. Older homes will have more idiosyncracies, and plumbing and electrical problems are likely to recur. So ultimately, he will have to spend money to have it fixed properly or you'll need to decide it it's worth the trouble to live there. A formal letter with your rent, indicating that you need to have the problem fixed or you will be seeking other housing arrangements may be the next step. If he agrees to allow you to hire an electrician...or reduce rent due to the problem...get it in writing.

I'd recommend you just move due to potential health risks -- falling in a dark shower, respiratory problems from mold/dampness.

Bad electrical is very dangerous. You need to call him and tell him you will place the call and get an electrician out before the place burns down. If you do not have now, go buy smoke detectors for each room. Make sure each window can easily open if a fire breaks out. Trailers go up in flames FAST. This type of landlord.is very common. If you want to move then pursue taking it off the rent. If you want to live safely pay for it yourself, and submit the bill with your full rent and allow him to offer a refund. It is illegal to manage this way. There are laws, slum lord laws, but at this moment having a save home is more important. Run dont walk about buy those smoke detectors, and a multi use fire extinguisher or three. I kid you not, your living in a very dangerous situation. Just stay very civil with an uncivil person, even jerks can come around if they choose too.

I doubt he'd let you, but I guess it wouldn't hurt to ask. If he does say no you have to pay the full rent or he will have the right to evict you. :S
Maybe you should talk to him and tell him that it is important and you are willing to pay *some* of it to get it fixed faster. Sorry, that does seem like a pretty bad situation.

I'm not a lawyer but from the one business law class I had, I believe you have an option to pay your rent into an escrow account. Basically you still take the money out of your account but it doesn't go directly to the landlord. You then notify the landlord that you are paying to an escrow account that they will get upon completion of the necessary repairs to make the place livable. Before attempting this though, I'd find someone who actually knows a bit more about the subject since I'm going off a class I took back in 1990.

You may also want to check with your county government offices to see if they have an agency that deals with rental inspections. I've lived in rentals since about 1997 (in a Maryland county) and we've seen a building inspector several times over the years. The landlord informs the community that units will be selected at random. Basically the inspector insures that the landlords are maintaining properties in adequate living conditions.

Even if your landlord is willing to work with people on rent amounts, the real concern is the safety of your family. Mold isn't something to joke around with. It can lead to various respiratory problems and even death. Electrical problems can present fire issues if not handled properly. The septic system backing presents additional health concerns as well as a general unpleasant smell (for you and your neighbors). As a paying tenant, you should expect all of your concerns to be addressed in a reasonable time frame while ensuring the safety of the tenants.

Would it be wrong to ask? No, not at all. Would it be wrong to unilaterally withhold the $100, yes, and probably illegal also.

Since most of the things you have listed are health hazards, you could always go the route of complaining to the health department. That would, however, subject you to condemnation and having to leave the home if the problems were bad enough.

Generally you cannot withhold rent for any reasons. I would work with you landlord citing the expenses you have incurred as a result of the lack of power. Let him know that you are willing to work with him but would appreciate a break on the rent this month since you have had to purchase a number of battery operated lights and appliances.

If you don't pay all your rent he has the power to put you out, regardless of whether you think the time it takes him to fix your issues is reasonable or not.
