Alli B | Should my Landlord pay us back for the Washer/Dryer we brought? |
My roomate and I have been renting an apartment for 2 years. Our lease is up September 1st, and come this Sept she will be moving to San Francisco and I will be moving to a new location.
When we first moved in, included in the unit was a Washer / Dryer Hookup. This was advertised. There was initially a small/ half size washer and No Dryer. We rarely used the small washer, as it could not do any more than a small load of kitchen towels, or delicates. Either way, we acquired a nice, working Washer / Dryer set. We moved the small washer downstairs to the basement (which is storage only- there are no coin-op Washer/Dryers in this space at all).
Now that my roomate is moving across the country, and I will be moving closer to the city where washer/dryers are more commonly in the basement, we will be leaving the Washer/Dryer we brought in the apartment.
Is it correct to think that the Landlord shold pay us for the Washer /Dryer that we brought to the unit? |

If the landlord wants to pay you that is his option. If he does not then take the washer/dryer that you bought. I have a feeling that you are just leaving it there because you do not want to move it. In that case I do not see that the landlord should feel obligated to pay you. He is not forcing you to leave it, if he were that would be a different story.
Yes, you paid for it. Yes, it is yours. However, it is also your decision to leave it. In that respect, to the landlord it is just some unclaimed property. |

NO!! Why on earth would you think that!..So if you left the couch the landlord would pay you for that too? I think not!..If you bought something and left it there that is your choice to do so..What is "right" is that you move your stuff out and move the landlord's stuff back where it was when you started renting from them..If you choose to leave them that may be nice of you but they don't have to pay for it!..ss |

You should sell your washer and dryer to the highest bidder and put the old one back into the apartment. Most leases require that the apartment be in the same condition when you leave as it was when you moved in. Replacing appliances may cost you your deposit. |

No, the landlord is not under an obligation to buy it from you. You could ask him if he would like to buy it, or you could just try to sell it to someone else. If you just leave it there it will become his. Chances are that's why the little one was there, since only "hook-up" was advertised.

Something else you could do if you don't want to just "give" it to him or sell it might be to donate it to Goodwill, Salvation Army, or another charitable org., get a receipt and use it as a tax deduction if you itemize. |

I suggest you sell your washer/dryer on craigslist.com for a reasonable price. You're landlord will most likely not give you any money and by law does not have to. If you leave it there after your lease is up, it automatically becomes the landlords. So sell it and save yourself the headache. |

The landlord is under no legal obligation to pay any amount of money for something you have done voluntarily. If there is a dispute and he/she is upset, they might even withold part of your deposit or charge you for "hauling away abandoned property." |

If the landlord keeps the washer and dryer in the apartment for the next tenant to use it just becomes one more appliance that he will be obligated to pay repair costs on like the fridge and stove. Not too many apartments come with washer and dryers. |

The landlord is under no obligation to pay you for the washer/dryer. If the washer/dryer was guaranteed in the lease and you just let it go, there's nothing you can do about it now. You can either sell it to someone or just leave it and eat the loss. My parents went through the same thing. |
