Should my landlord (agency) tell me the intentions of the owner before i signed the contract?
3 months ago i moved into my property i was told when i viewed the house that i would be there for years and i clarified this as i have a 2 year old and pregnant, the agency said that i would. So i intially signed to 6 months agreement on the basis that it would be extended.

It now turns out that the agency knew that the owner of the property was selling and that my tenancy agreement was only for 6 months and would not be renewed. I was never told this.

Does anyone know whether this is legal? Should the agency have told me the intention of the landlord before i signed the Tenancy Agreement?

If you're in the UK, this should have immediately flagged warning bells to you when you signed. A standard lettings agreement is one year and I would immediately have questioned why they wanted you to sign only a six-month contract. Remember that both the landlord and the agency want the tenant to stay for as long as possible (under normal circumstances) as it's expensive and annoying to constantly have new tenants coming and going, so there was certainly no benefit in it for them.

Of course an agency would not tell you that they knew he would do this. Think about it - no-one would want to live there for such a short time so they wouldn't be able to let it. Anything could happen in those six months and the landlord might decide he doesn't want to sell after all, so why make trouble for themselves?

They haven't acted illegally, and to be honest I think most agents and landlords would have done the same in order to let the property.

The bottom line is, if any kind of agreement is signed for a limited time period, then neither party is required to extend it at the end of that time period if they do not wish.

They must tell you if the house is listed for sale. However, the owner may not have made their final decision and signed paperwork to list the home.

Unless the was something concrete, they can not tell you what may happen. It is also possible the agency did not know the intentions of the owner.

If you had planned to be there longer, you should have asked for a 1 year lease at least.

Is it crappy customer service? Yep.

Is it illegal? Not really. They gave you a six month lease, meaning you weren’t promised the property in writing any long than that. (What anyone said is irrelevant; if it wasn’t written, it never happened.) Even that lease probably had language that would allow the landlord to terminate it with some notice. They’re under no obligation to renew your lease. This is a risk of renting.

Yep. You are stuck with what you signed. If you wanted to be there for longer you should have asked for a longer period to appear in the agreement. People say all sorts, it is the agreement that counts. A lesson learned.

Leagully theres nothing you can do since you only signed for 6 months that is all the are intitled to give you.

Not a lot you can do, legally they have done nothing wrong, morally possibly. Have the agents given you notice yet? if so take it to the council.

Not good news for you I'm afraid - Your agency have done the dirty on you by insisting you sign the initial short term contract of 6 Months.

You were merely a useful Tennant to get the Property off their books for 6 Months - With hindsight you could have insisted on signing for a minimum of a Year (especially in the personal circumstances you describe).

Chalk it up!

Best wishes to you & yours.

On my way to Zion
Strange, we have just moved into our house a few months ago, and the owner was actually selling it, and decided not to, but was still umming and ooing even when we paed the deposit money, I explained to the agency, that we have 2 children, and I am pregnant, and am due in 6 months, so the 6 months contract will be around the time I am due, so if he is not sure, they have to let us know.

he thing is, if its not in the contract, its your word against theres, although if you were to take it further you could, as its obvious you would not do all the hasle in moving to somewhere whilst pregnant only to be moving out again, when you were told its going to be a long contract, but again, you signed a 6 months contract, ring your local CAB, go to http://www.google.co.uk and type CAB in and it will help go to your local one and they will give you FREE advice.

Good luck :-)

No - this is not legal and YES they should have told you.

Landlords/ Property managers are legally bound to notify a new tenant if the place is for sale.
