Should my landlord have to pay???
I'm living in a rented fully furnished appartment with my boyfriend since August 1 this year. The appartments were brand new when we moved in so we were expecting to have no problems. However, with the house being brand new and due to the bad weather in Ireland, dampness came through the gable wall and into the bedroom i share with my boyfriend. The room was freezing and the wall and window was destroyed in green dots. However, the green stuff also went through the wardrobe which the landlord had placed up against the wall, destroying about 70% of my clothes. I've tried washing them on numerous occasions but i cant get rid of it. The landlord was very apologetic and got a professional to come and fix it. the dampness is no longer a problem as we are using a dehumidifier. Then last night the microwave just blew when my b/f turned it on. Is it cuz the stuff is cheap? Should the landlord have to pay for it? Should I say it to the landlord about my clothes which have to be thrown away

the landlord himself that the only reason the appartment was damp in the first place was because the builders never closed up one of the cavities. the appartment is brand new-built only within the last couple of months. It should not be having problems already

I would at least talk to the landlord before just throwing out the clothes and purchasing a new microwave. Could be that there's a short in the wiring also. You SHOULD have the electrical outlet checked out before plugging in another one that may cause a fire.

The builders insurance just may cover it. In the US, builders must purchase insurance for that kind of thing. A lot of times, they warranty new homes/apartments for a year after purchase when they are brand new.

Won't hurt to at least follow that road first, and be kind. If you go into this with a sour attitude, it may just blow up in your face.

The Landlord has not been negligent here and acted properly when he became aware of your problems, so has no legal liability. Therefore you will be very lucky to get anything out of him for your clothes I'm afraid, although you could ask and see what response you get. Having said that if the Landlord provides the building insurance (which is the norm on rental property), you may have a claim on that, so look into this - if there is an excess of say £250 he may be prepared to bung you that instead of the hassle of a claim.

Otherwise I think you will just have to put this one down to bad luck!

Why don't you claim on your home insurance. may be a problem now you have thrown the clothes out though. You could ask citizens advice, if your in the UK, if your landlord is liable to pay. If it was a brand new microwave less than a year it should be under warranty. see if he has a receipt.

I don't know about thelaws in iraland but hear in the states the land lord is not responcible for your personal stuff.

I realize the laws of your country may vary from mine.

In the United States, you need to purchase renter's insurance and unless the tenant can show landlord negligence, there is no claim.

i think your landlord has nothing to do with the microwave :) you should shoulder the expenses that has brought by the accident from the microwave. likewise to your clothes. what happened was a fortuitous event.

hell yes he should pay he is responsable for upkeep on the building. hell if he doesn't fix it with hold rent or something. if he doesn't he could be taken to court as a slum lord.
