Signing Apartment Lease w/Boyfriend...?
My boyfriend and I applied and were approved for an apartment today. It's a 12month lease. It's a really nice apartment $1000 a month just for rent, EXcluding any other bills, 2bdrm/2bath. Anyway, we're both 23, college students, and employed. I'm just really nervous that if he doesn't pay his portion, he will negatively affect my credit. I hope nothing happens between us, and I hope he keeps his steady job, but I can HOPE all I want,......what can I do to LEGALLY protect myself, just in case he decides to bail and not pay his portion of the rent/utilities. Where can I get a Personal legal contract for him to sign with me? I NEED to protect myself just in case anything happens because the rent by myself would be pretty steep for me. I am never late on bills or what not, so I do not want to start now.

Also, what other types of agreements and planning should we think about/discuss before we actually move in? Such as utilities/groceries/furniture/water usage/thermostat .....I am very anal about saving money and making things run smoothly!! Any input is appreciated! Thanks :)

The "jointly and severally" clause of the lease puts you 100% on the hook for the rent vis-a-vis the landlord. Didn't you read the thing before you signed it?

All you can do is get him to sign a contract between the two of you that A, B, C and D as expenses will be split absolutely 50-50 for the duration of any lease that you have together.

If you are so anal about saving money (and I applaud this) you better dump this guy and find one that matches you in this and your preferences in utilities/groceries/furniture/water usage/thermostat, as it seems to be so central to who you are.

The #1 cause of break-ups is incompatible monetary habits. For God's sake don't make babies with him.

To late now!
Never sign anything with BF/GF.
You should have done your thinking before signing a lease.
I cannot tell you how many BF/GF break ups I have seen in this business in 25 years.
Most of the time, the female gets had.
Best of luck.

You will not be able to protect yourself. The lease will say that you are jointly and severally liable. Sorry.

Debra G
As was already stated, it is a joint lease. If you pay your portion and he can't come up with his portion, the landlord will sue both of you. He doesn't care who paid what, he wants the full rent. As far as an agreement with your boyfriend, if he doesn't pay his half of the rent, you have to take him to court and sue him for the money he owes for his half. Does he have good credit? If not, he won't care if you threaten to take him to court if he doesn't pay his share. Also, you both have to decide who pays what when you move in together. If you don't decide that before you move in together, you will have problems. Open a "bill" account, and each put the SAME amount in per pay period, and stick to that. All of the worries and concerns you stated above, is why boyfriend/girlfriend room mates don't work out sometime. It is hard for married people to room together and split bills, let alone just living together with no commitment. Hope everything works out OK...

Being so worried at this stage after signing on the dotted line is really moot. You are both liable to the landlord for the rent. Sure, you can get a signed paper stating the outline of how you intend to share the other things, but didn't you have these thoughts before you signed? Hopefully, the next year will go ok, and you won't get left in the lurch. If you do, you and your b/f will have a small claims court date. You should have talked about this stuff before you even looked at apts. It sounds like you might have got caught up in the excitement of moving in together. How long have you been dating this fellow?

Jackie
You really shouldn't sign a lease with someone who you don't trust to not to "bail out" on you.

Real Estate Guy
Hey everyone, lets get a pool together to see how long it will be before she is back asking the same questions because him LEFT HER HIGH AND DRY.

Do you want to protect yourself, then don't do it. If you already are worried, it will happen.

Hope and love (and lust) is one thing. Responsibility to yourself is another.

I would say do not do it and this is coming from experience!! I got an apartment once with my boyfriend and we had been together for almost 4 years, haha big mistake!! We ended up breaking up, luckily I was able to get out of the lease, but he stuck me with the gas bill, cable bill, phone bill, and a few other bills related to the apartment. Infact half of it was that when accounts were set up for these bills he had put some of them under my name and basically hid it from me and at the same time let the bills rack up. Needless to say, sometimes you never know how much you really know someone!! I would just be careful!!

you should]n,t do it, don,t sign a lease, and don,t move in together, yeah, find your own separate places, be smart, see how it goes, who messes up, then no one to blame, i wouldn,t do it, just hang around together if you have to live like that, and be cool, but, moving in together, you are asking for problems, here you are on yahoo, asking how to protect yourself, your relationship sounds unsteady already, be cool and move in by yourself, get your own place,
