Since a large piece of my backyard slid into my neighbors yard, how much should I bill him for the use of it?
This may sound like a stupid question, but you have to understand that in Southern California, land has an extremely high value. I seems to me that since he has about a quarter acre of my property in his yard and pool, not to mention the maids quarters, he should at least pay me something.

Real estate is appraised according to its "highest and best use".

What do you think he will use it for? It sounds like a great site for bmx course, which could earn big bank!

Sue him for his future profits.

Yeah, that's the ticket!

You will pay him a lot more for the damage to his property than he will ever have to pay you.

Ipsydoodle
Careful what you wish for. Neighbor dude can always say 'take it back' and then start billing you for storing your backyard on his property

Blue October
i too live in southern CA and i think you are incorrect.

YOUR backyard slid into his area?...onto his property right?

you should be paying to rectify this situation, do the clean up and get this mess off of his property. i would suggest that you even pay to make his property the way it was prior to the slide...and in addition, you might consider a retaining wall.

i am sorry...but you are at fault and you should right this situaton. If you were my neighbor i would expect it.

good luck :)

mozbrat
Maybe the cost of removal due to your slide?

What do you mean by slid into? If i were him i would be charging you for ruining my property. Its not his fault it slid there.

In Real Estate, Land has value. "Dirt" does not. Find out what it costs to remove the dirt from his property and make arrangements with your neighbor to restore his property to what it was.

The property lines did not change. You still own the same amount of land. In fact you are liable for the damage your dirt did to his property. Expect his insurance agency to come after yours.

Throw a quarter stick of dynamite into the San Andreas fault to start a minor earthquake which will make your backyard slide back to where it belongs?

Depends on the location, but I would start at $1.50 per square foot.....unless he's now using it for income producing activities in which case $3.25 per s.f. is a good starting point.
