When we first moved into our apartment of course everyting looked okay, come to find out there was a leak in our kitchen, bathroom, and master bedroom, the first night it rained, We told this to our landlord and he said he would fix it, months went by with promises and still nothing, finally we told him we would quit paying rent until he fixed it, he said he would get it fixed, 6 months went by, we never had to pay rent but we did have to deal with the leak that had gotten worse and worse, we never heard one word from him until a week ago he filed an eviction on us, we went to court, with pictures of the leaks, water damage and even black mold that has appeared on our walls. The Judge simply refused to look at any of our evidence and ordered us to pay 4k+ in back rent.so is there anything that I can do about this? It can't be right that he refused to even look at our evidence and consider the apartment unsafe which it very well is now with the mold. |

Withholding rent is illegal, there is no evidence that changes that.
You took the law into your own hands, this was not a bad judge, just one following the law. You broke it, not him, not the landlord.
If you had moved out you may have had a defense, but the fact that you stayed proves, 100% that you found the apartment to be safe and you were not concerned about the mold. |

The judge ruled correctly. You do NOT get to not pay rent because you are simply demanding repairs. You elected to stay there, so you owe the rents for the time you were there, leaks or not.
The judge didn't bother with looking at any evidence because there was no need to look at it. He knows the laws. |

If a tenant plans to withhold rent, certain legal procedures MUST be followed.
The judge refused to look at your evidence because you tried to take the law into your own hands...judges don't like that at all. |

The problem is that you waited till he filed.
You should have filed and paid your rent to the court with an order for him to do the repairs.
The options should have been discussed at the hearing
would be something like pay by such and such a date or move out and really if its that bad and you haven't been paying your rent then you should have moved out long ago these hearings arent fast they take months to get to so you have had lots of notice.
get out find somewere decent before the sheriff comes or you will lose your stuff too. |

Most likely the judge had no choice, since either your state did not allow withholding of rent or if the state does it usually requires the tenant to place the monies in escrow with the court, as such your failure to follow state statute did not allow the judge to find another decision |

You should have moved. Unfortunately, the fact that you stayed there shows that you were OK with the premises whether or not the landlord maintained it.
If you left and broke a tenancy agreement, it would be ok because afterwards, you can explain to the judge that you left due to the state of the place. |

Next time, read the laws before you decide what to do about a landlord problem. State and local law govern your situation. Judges interpret and apply these laws, and if you did not follow the rules, they cannot help you.

They are right you can't with hold rent. You should have then filed a claim in small claims court against him. For being a slum lord. You do as a tenant have rights. You just have to keep paying your rent. Depending on what state you live in there should be a tenants right website. You have to pay the rent, but for the repairs...Your city may have a property standards division, they can send an inspector and give your landlord a work order to get the leak(s) fixed and the mold removed. In my city, it's free to make a complaint like this. |

NOPE - YOU CANNOT WITHOLD RENT FOR THNGS NEEDING TO BE FIXED!!!! He had every right to evict you for non-payment of rent, and the judge did not have to look at your pictures because you were in the wrong.
Find a new place to live - and if things go unfixed in the future, know that you still have to pay the rent or get evicted again.
The proper course of action (in most states) is to send a certified letter of the needed repairs to the landlord. They then have 30 days to get it fixed. If it is still unfixed you can have a liceced contractor fix it and take that amount ONLY off the rent and make sure to keep receipts. |
