Smoker will not go outside to smoke. His smoke drifts into my apartment. Says hes sorry. What to do?
I live in a duplex. A tenant below me smokes. Hes agreed to go outside to fullfil his habit. Yet, on occasion, will stay in his apartment and smoke up a storm. The smoke then drifts up the stairwell into my apartment, which is why he has been asked to smoke outside. This is not easy for me to deal with as I am on oxygen and need clean air to breathe. I have reminded him several times that I do not like the smoke. Hes appologized, says he had freinds over and forgot to tell them to go outside, then were fine for a while, and then it happens again. Complaining to the landlord has accomplished nothing - except more appologies. I'm tired of hearing "I'm sorry" and want to move but I need a minimum $600 to pay for the boxes and storage if PODS will put a storage box in the street as my house has no driveway. If I have to rent a truck, the cost will deffinately go up. Even though I was here first, its like I have no say. He has OHA pay his rent, I have to cut grass to pay mine.

Thanks for the replies. First of all, there is no lease, it is month to month. It isn't a 'geezer', it is a 22 year old kid. He has been here several years. He has been asked since day one to take his smoking outside and he agreed to do so. So, even though it isn't in the rental agreement, there is a verbal agreement. I have told him he can smoke in his apartment all he wants, just keep the smoke to himself. The problem arises when he invites freinds over at 2 am and they all smoke up a storm. He forgets to tell his freinds to go outside. My landlord is my brother-in-law and he knows my financial situation and how difficult it would be for me to come up with the money I need to move. It would be more practical to have the young adult move back in with his parents. Keep the replies comming in. I enjoy reading them.

Sorry, unless there is something in the lease about not smoking in the house he can. If you don't like it you can talk to the landlord, but again unless there is something already in the lease the landlord can't make any changes until the lease is up.

So, if the smoke is bothering you that much you either need to add air filters or move.

You can choose to move if you wish, but I hate to break it to you. Regardless where you move, somebody will be smoking somewhere. So the best thing for you to do is to deal with this now, before you go broke in moving fees.

Smoking is a legal activity and he's free to smoke in his own home. There are precious few places smokers can light up anymore, and to expect him not to smoke in his own home is absurd.

(And I'm an ex-smoker, believe it or not!)

Unless his lease forbids smoking you have no option but to move. You are lucky he goes outside at all.

I am not sure about your predicament, other than maybe he can seta fan at a window and smoke near that.
Also, why and how are you cutting grass if you are on oxygen?

Unfortunately there is no law stating that he can't smoke in his apartment as you are free to do as you wish, within the law, in your own home. All you can do is ask him as you have been but the landlord is under no obligtion to do anything about it unless you have all signed a tenancy agreement stating that no-one can smoke in the communal block.

Actually...you don't have any say. If you don't want smoke in your apartment, then seal your doors. You can't change the world around you.

You can ask the kid all you want to go outside to smoke, but he doesnt have to. The only way he would have to is if its in the lease or its a documented no smoking building.
Just because you were there first doesnt give you any right to dictate to another tenant. He pays his rent just like you do. If you decide to move, he is also not responsible for the cost, you are.
I am on oxygen too and a former smoker, so I know how you feel. However they have rights. And if your landlord is telling you he is sorry, that means he cant do anything about it either. If he tries to kick the kid out for that reason, he can be sued for false eviction. Especially since the apt is not a smoke free one. No one has to change their habits because you say so or you dont like it. Face it, you are just a tenant too. As long as he is not smoking while in your apt, you have no say so. Sorry, but thats the facts and the law.

without going into all the complexities - he has the right to smoke - you have the right to breath clean air & the landlord has the right to hope you both figure it out so he can keep collecting the rent. Keep reminding the old geezer downstairs - try putting a fan in the hallway (pointing down) if you notice it again (or should I say the next time he does it) also - check at the local Menards or Home Depot - see if you can get some door weather sealer - try sticking a small You can get one at Menards) no smoking sign (in the hallway) near his door (steady reminder & nicer weather is coming so maybe he won't mind as much) it's costly to move - good luck :)

Speak to the landlord. Are the apartments rented as smoking or not smoking? If yours is not smoking, I'd definitely complain to the landlord, as you may have to pay for smoke damage when you move out. If you keep bugging him to not smoke, he may eventually not, just so he doesn't have to hear you complain. I'd start w/ the landlord though. Also, whoever was there first should be the one who stays if the landlord insists one of you move
