So i rented my apartment to a man that works at the hotel, his rent is due on the 1st of the month?
today is the 18th and I dont get his money as yet, here goes-I called him on Friday and he told me that his father had died and he was so busy so he will pay the money on Monday, when i checked the account the money is not there, anyways I tried to call him yesterday and I sent him a text and he did not reply. Not that I am not sorry about his father's death, but dont you think he should call me and say something? He just rented the place since June 23rd and I told him to take the rest of that month free and he should start paying as of July 1st, all he paid was the deposit. You must take action, or you will set a standard of acceptability. Which will make it harder for you to evict him in the future. Make sure you send letters (keep copies) saying that rent is due and he must pay. Do you charge a late fee? Is that written in the lease?

What I do is give my tenants a incentive to pay early. My leases state that rent is due on the 1st of the month, but if you pay on or before the 5th I will give you a $50 discount off of the monthly rent. They don't know that I set the rent $50 higher than I wanted. If they don't pay by the 5th they don't get the discount and I made an extra $50. And I can also claim that my rents are $50 higher than they actually are when refinancing and valuing the property.

He has been residing there for less than 30 days so boot him out ASAP! after 30 days he is considered a legal resident. Call him and tell him if you dont reieved payment by the 20th ur changing the locks and kicking him out as well as returning his deposit. Being that hes been there for less than 30 days he is not a legal tenant so you do not have to go through the courts to evict. If he is there any longer than 30 days then u have to. So tell him he has until the 20th then ur changing the locks and putting him out. Dead father or not the rent is still due and u have a mortgage to pay. Banks dnt care so why should u?

For starters do you have a legal written lease or was this a verbal agreement?

A written lease should clearly define to him when rent is due and any late fees and/or penalties for being late.

With that being said send him a written notice advising him rent and/or late fees are due immediately and that he must pay, don't forget to include that you have made several attempts to contact him without success. If he fails to oblige proceed with the eviction process.

Better check references next time. Maybe a credit check, too Time to evict him. That's gonna cost you a pretty penny.

Send a letter (so it is in print) by registered mail, so you know he signed for it. Tell him the rent plus a $30 late fee is due within two days, or you will take legal action to evict him.

You can't just do it by phone -- there is no proof of the conversation.

He's a deadbeat. You are going to have to evict him. Do not refund the deposit. It will cover the rent.

Post a note on his door pay up or get up, then if he does not pay by the day you have given him start the eviction prosses.

I would check the obituaries and make sure his father really did die, instead of just his bank account.

First on 2nd you should of put a friendly reminder on his door.
It's time you gave him his 30 day notice..

Even though his dad died, he still has to pay the rent! You have been understanding enough. I would stay on him, you need your money. You probably should have gotten the deposit and July rent at the same time. August is only 2 weeks away, tell him it needs to be on time or there is a late fee after 3 days late. Good luck!

He is a bum! I would send him a letter certifed mail, discussing the late rent. Keep a copy in your file, so when you go to start eviction proceedings you can have proof. And besides even if his Father died, he still could write a quick check, or send a money order. His next excuse will be my Mother is really sick, the dog ate my checkbook, etc. etc.

(Hmmm...where I live, if you work for a hotel/motel/apartment complex--you get a very small salary + free apartment).

I would give this guy a break. His father's death probably drained him financially, physically and emotionally. If he wants to continue working for you, he will either pay or allow you to deduct it from his wages.
