marigolds11 | Someone attempted to break into my apartment. Is that legal grounds to break my lease? |
I really don't feel safe anymore and would like to move, but I just signed a 12 month lease. |

No, it has nothing to do with your contract, unless of course your landlord is arrested for the crime itself. |

Unfortunately, it's not legal grounds to break your lease. You say you don't feel safe in your apartment. Suppose we turn that around. What if your landlord wanted to evict you just because he didn't feel safe with you in that apartment. Could he evict you just because of that? Of course not. I know that sounds harsh but the law isn't designed to protect how we feel. It is designed to prevent one person (you in this case) from passing your problems on to someone else (your landlord).
You don't have any legal grounds but that doesn't mean you don't have moral and emotional grounds. Landlords are people too, so an emotional appeal to your landlord for help is in order. He/she may let you out of your lease (probably for a fee) or maybe he/she would be willing to beef up security on your apartment. A discussion with other tenants might be a good idea beforehand too to see if this is a pattern or is just a random act. |

no, it is not. your landlord cannot be blamed for the fact that someone tried to break into your appartment. as long as he/she has provided functional locks than that would not be a valid reason to break the lease. have you spoken the landlord about the issue? have other apartments in the development been broken into? if you really want to get out of your lease, talk to the landlord and try to work something out...but read your lease carefully and be prepared to pay a penalty. the fact that you just signed up is going to make the landlord unhappy. |

Not unless your landlord was grossly negligent. I suggest you talk to the landlord and see if they will let you out of the lease. If you decide to stay, you should add additional locks, security measures, etc. Get your landlord's permission to do this also. Sorry about your situation and good luck. |

No. Unless it was the landlord, this stuff happens. |

You don't have legal ground to break the lease. However, the if you go to the landlord and explain the situation they may be able to give you a few options.
You can vacate the apartment...but you would be responsible for the rent till the lease is up or the apartment is rented, whichever comes first.
They may let you vacate after giving a 30-60 day notice. That gives them some time to find a new resident. You might end up being responsible for the rent until the new person can get moved in. Say 2 weeks after you move-out date.
However, your safety can't be guaranteed anywhere that you are living. My suggestion would be to get an alarm system. You figure all the money you would spend to move you can just spend that on the alarm. |

Nope, it sure isn't.
Crime reports per the area that you leased in is public information, which is why the landlord isn't required to disclose it.
Know that anyone, no matter what neighborhood they live in, can be a victim of a random crime. |

You aren't legally entitled to break your lease, but there are a few options.
Contact your landlord and ask. You might be allowed to move if you provide substantial notice. Normally, a 30-day notice is required, but if you were willing to give 60, they might let you out.
Second option: If you are willing to show the property to prospective tenants, (s)he may allow you to break the lease, simply because it saves time and energy on your landlord's part. |

No but if you have a police report and explained it to the landlord they may let you out. Otherwise if I didn't feel save I would just move and abandon my security deposit. |
