gcoolie | Someone tricked me into signing papers. What should I do? |
My sister & I owned a house together. I've been living here for more then 15 years. I trusted her. However, on the night before I was supposed to leave for Japan, she told me that we needed to refinance the house and took me to a place to sign papers. I was trusted her so I signed them without reading them carefully. She completely caught me off guard because I was such in a hurry to leave and and now the house is under HER name. The house is a duplex and she just moved in recently. I've been paying the mortgage here for more then 15 years and she hasn't contributed to one dime. No she's trying to tell me I need to pay rent!!! I want to know, what are my rights? Can I take any type of legal action against her? Or is there nothing I can do because I signed the papers and in front of a witness? Please help. Thanks in advance. |

Well if you cant find a way to "legally" get the house back, i have a suggestion to get it back. Sue your sister for the full amount of the house and get her served with papers. Once you know she has the papers, ( i mean the second she is served) talk to her like you are trying to get the house back. Act fed up and then just say forget...keep the house and tell her you are going to drop the lawsuit and she will have to live with herself. (Dont really drop the lawsuit though) Just let her think that its dropped so she doesnt respond for the 20 days she has to respond. Once the 20 days is over, you can get a judgement and collect the house as payment legally and there is nothing she can do, not even with the best lawyer in the world. (this happened to me and thats why i know it works! Some company basically robbed me this way for 2600 dollars and there was nothing i could do. They told me they would drop it and they didnt!)
That way should be a very last resort though when all other avenues are exhausted. Also doing it this way would probably force the sale of the house, but anything you dont get you can keep collecting from her. (If you learn how, you can also seize her bank accounts this way, but thats a little bit more complicated) |

reread the contract. what did it say. if it said anything that wasn't neccesary tell somebody in your family. How was it illegal. Did you sign as her name or your name. If you signed as you the house should be yours. |

Sounds like you are screwed, she took your equity... who signs papers without reading them?.. Anyways.. Looks like you will need to threaten to sue your sister or have her refinance once again to add you to the mortgage. |

Get a lawyer to find out. Unfortunately, there's going to be all sorts of undesirables here giving you bad advice.
Personally, I'd disown her and hire some people to...I digress...get a lawyer. |

You need an attorney, but unless you were unable to understand the documents for some reason (drunk, insane, etc.) it is unlikely you will prevail. But talk to an attorney ASAP.

You may be able to take legal action if the terms of the papers were unfair, however, you probably will not be able to since it was your fault you didn't read the papers carefully. My advice is to talk with her and attempt to convince her that she is in the wrong. After all, she is your sister. |
