Spouse's Foreclosure?
My husband and I live in CA. He purchased a home completely on his own. I was not on the loan and I did not sign any loan documents. I am on the deed. When ever I have my credit report run, the home loan is never in the report. If the house goes into foreclosure, will this affect my credit?

CA is a community property state. You will be effected. You equally own all assets and debts of your spouse.

Me
I think it will. It's hard to separate the credit of couple living together. Actually, you don't even have to be married in order to have shared credit history -- having one or more shared credit accounts and that would do the trick. After that, it is tough to separate credit records -- even after a separation of the relationship. So, if you have any other shared accounts, then whatever happens in the future to one will affect the other.

shiprepairwoman
It is a community property state so you are exactly the same as your spouse. If you have anything to do with the house like your name on the deed it is comingled.

kckid2
Your credit is safe. But if you live in the home, then that could very well mean you need to find a new address. The lender can take the house.

Annick J
Your name has to be on the mortgage to affect your credit. Your name is only on the deed because your husband gifted part of the house to you. However, the mortgage is still a lein on the house and you will lose the house in the event of forclosure.

YEP.
You're married to him, you're on the deed, you're on the line.
Speak to the lender, see what you guys can work out. There are options, IF you're willing to cut back and try.

estielmo
Quite likely. Your credit reports are mingled by marriage. The loan won't show, but the foreclosure probably will.

Jimmymac
No, only the mortgage company can foreclose and you never were on it.

Rating
No because the loans in his name.
