Boomer | Stealing - Or is It? |
If I was looking for an apartment that a Realtor said was vacant and available now and gave me a key to check it out and I found personal belongings in there; would taking them be stealing? Bear in mind that the former tenants have left and the apartment was clean and ready to move in. The items might be in a storage room adjacent to the apartment and the former tenants would never return and that anyone who visited the apartment could also take the things that remained. If I took those things just by looking at the apartment; would that be stealing or just cleaning up the place? Additional Details I did not mean to say that I was the one in question. I was asking a general question because I know someone who looked at a vacant apartment and did take some items from within. She said that, "well, the next person who looked at it would have done so". I am asking on her behalf. Actually, she might be right. |

If you took the apartment and kept the things no that would not be stealing because they rightfully abandoned the articles and once you take owner ship you take the contents as well. However if you are just looking at the place then that is stealing because what gives you legal right to those the legal right should be to the renter |

No, it would be stealing. Just call the realtor and ask what they plan to do with the things still in the place, provided of course that you are renting the place. If they say it is yours, then it is yours, otherwise it will give the owners an opportunity to retrieve their things.

Actually she is wrong. If it isn't yours, it's stealing.
Get rid of that friend. She is short on morals and you could be next.
If there are personal belongings in an apartment and you are told it is ready to rent, then it really isn't. Things left in an apartment have to be disposed of in a legal way and someone walking in and taking them isn't it. |

Only if the realtor said it was okay. I know people sometimes leave nice stuff behind just because they don't want it anymore and anyone who wants it can have it. You need to ask the realtor first. If no one wants it, then it goes in the trash. |

Why are you asking us instead of the Realtor? I would guess because you don't want to alert him/her of the presence of the items.
Taking without asking, and keeping it under wraps, sure sounds like stealing to me. |
