I bought a house in 2006. When I first purchased property (a house and just under 5 acres) I got a 1st and 2nd mortgage at Wells Fargo Bank 6% fixed on first and like 10.5 on second. My then girlfriend insisted on changing mortgage to a variable with a minimum payment due that does not even cover the interest. She wanted this to save money while she was in school. She also ran a credit card up to $18k and another up to $3,500. My credit score went from 750 to 450. I also put her name on house I thought it was in case I died but I have to have her signature to sell house. My question is how hard will it be for me to get out of this mess. I have already paid an attorney $5,500. Also when the credit was dried up she first asked me to leave me house and move in with my mother which I did for her son's "security" she was going to take over the payments she made 1 payment then moved in with her new boyfriend. What a mess!!! |

I'm thinking you need to start looking at bankruptcy. Sounds like your credit rating is shot already, so it won't hurt it.
Stop seeing your current attorney and get to a bankruptcy attorney.
The longer you put it off, the more its costing you. |

Work on improving your credit, step by step. Can't do a refi until you get better credit rating. Pay down on the loan as much as possible, because you are growing your debt when your payments don't even cover all the interest. Look at all the programs available to help us due to bailout, maybe you can qualify for one. Get EX to sign a QuitClaim deed to you--attorney should draw it up cheaply as you've paid him a lot already. Need her signature notarized. Get her OFF title. If she won't cooperate, you'll have to sue to quiet title, talk to attorney about your options. |

Yes you really have a mess. What is the attorney doing for the money you gave him? Do you have any equity in the home? Or do you owe more then it is worth? When you say you put her name on the home is she also on the loan? Yes you will need her to sign if you sell if she is on title. |

This is a mess bro, Never, never, never co-sign, or buy real estate with a boyfriend or girl friend, or listen to someone your living with, with no (Skin in the game) people are pretty Cavalier with other peoples money even if they are sharing a bed with them. If you are married that piece of paper means your both on the hook for the house, and any debts, she just can't be bob away.
Suggestions: Can you renegotiate the adjustable with Wells Fargo? They might deal, with so, many houses on the market it's worth a shot. Two anyway to get this diz off the house she more than likely had a crappy credit score before you meet her if you can get her to quick claim her off the house it's one less head ache. What what did your attorney say? anything useful?
Last I'm not sure what state your in but I would suggest calling 1-866-259-8206 and ask for the Mortgage Help Center This is something done by a Consumer guy here in Colorado named Tom Martino by a company called American Guaranty Financial they may not be able to help, but it's worth a shot.
