Submitted a 60 day notice and 8 days later told them that I did not want to move out.?
I gave them the 60 day notice on the 10th and called them back on the 19th and told them that I didn't want to move b/c I accepted a permanent position at my current job. They said that they already leased my apt out and that they could put myself and 3 kids in a two bedroom apt. Keep in mind I have two girls and a boy 11, 14, 15. Not a great idea. I don't have a car and live right by the train station which is a block away. which is how I get to work. They told me I have to move. What rights do I have?
You gave legal notice to end your contract. The apartment complex then entered into another legal contract with the new tenants.
Your notice is binding. As others have stated your only recourse seems to be finding another apartment.

You really don't have any. You submitted the notice. They found a new tenant. Either accept the new apartment in your current place or find something totally new.

Apeal to the manager on a personal level, If they want you out for other reasons then you are screwed but if you make a freind there you might have a chance. Also it seems kind of fast for them to get a new tenat. Ask them if you can stay and go up the chain of command untill you can't apeal to any one else. I'm sure they will work with you if they can.

As you submitted you notice they had a right to get a new tenant and there is nothing you can do.

You still need to move, you gave notice. It was not contingent on you simply changing your mind.

really none. You signed the paper to move, its their job to lease that apt. which is exactly what they did. It seems like within the next 60 days, if another units like yours comes up maybe they can move the new person into it or let you move into it, but you signed the papers to move, its not up to them to hold onto it and say hummm wonder if she changes her mind, it doesnt work that way.

Will they agree in writing to move you into the first available bigger apartment without penalty or fees? That's your only hope.
