Suing previous home owners for bat problems?
Can I sue a previous home owner that didn't tell me that had a bat problem?

This last summer/fall we noticed we had a bat problem. we paid someone $200 to come out and take care of the problem.

then last night we had another one.

I am not suing because i am sue happy!

Just so you know!

It is because they withheld information from us! Had I known there was a bat problem with the house I wouldn't have bought the house.

You can certainly file suit, but you'd most likely lose, and here's why.

First, you'd have to prove that the owners knew they had a bat problem. Unless you have undeniable proof you will lose.

Second, even if you could prove that they did have a previous problem, it's possible that they, in good faith, paid an exterminator to get rid of the problem (just like you did). And it's not their fault that the bats returned, after all, your treatment didn't eradicate the problem forever, either.

Many homeowners have problems with different types of vermin - bats, rats, roaches, termites. It's just part of being a homeowner to have to take care of it. And when you get ready to sell the house someday, you'll not have to disclose a bat problem if you've taken care of the bats, either.

Apparently whatever the exterminators are doing isn't preventing the bats from getting in. Until you find their source of entry you'll continue to have a problem. I hope the company you used last time will come out again and try a bit harder to find a perhaps less obvious point of entry.

An inspection before buying the home would have been the best thing to do. If the company that treated your house to rid it of bats didn't do the trick--call them back. You can sue anyone for anything but don't expect to win.

I doubt it. Bats are not pests. You could just as easily have swallows or squirrels.

How do you know they withheld information from you? Maybe the infestation occured after you bought the place. Quit watching "Judge Judy," get the exterminator to finish the job and move on.

You have no case unless you can prove, and I mean by solid evidence, that the seller knew about the problem. Also, even if you can prove it, the cost is so small that it is not worth pursuing. These things are more trouble than you think. I think your question is legitimate even if the answer drew much negative sentiment.

You should have had the property thoroughly inspected privately. Sorry to say, that if you didn't that's your fault and if you did then you picked a bad inspector and maybe you should sue that person.
