I live in the Buffalo, NY area and I have had a ton of issue since living in the home I live in for now 2 yrs. Every issue I address, my landlord either ignores or promises to fix, but never does. For the last 4 months we have a new tenant who moved in upstairs. she is young (21-22 yrs old), mother of 2 kids (9 months old and 4 yrs old). she is loud, disrespectful and ignors my complaints about her kids. Her older son, 4 now, runs, jumps and screams all day every day until 1-2 am almost every day. her boyfriend comes in and out of the apt upstairs w/his friends, smoke cigs and mariguana in our adjoining hallway, parties all hours of the day and night. I even had the US Marshalls come here asking me questions about her and the boyfriend. I have called my landlord EVERY SINGLE TIME to complain and he does NOTHING. I've called the local police dept and they tell me there is nothing they can do. They talked to her once and during a conversation with the tenant upstairs, her 4 yr old son, just walks into my house. The police asked her why she let her son do this and she said she can't discipline him because she feels bad..... The police are aware she is "incoherant", but refers me back to my landlord. Who again, ignores my complaints or blows smoke up my butt... Now i was notified he is selling the house and he is telling me "we both are leaving", due to the amount of complaints. Since he has been as rude and uncooperative as my upstairs neighbor, do I have to be cooperative with him during showings and open houses? Is this a law? This is only a few of the issues I am having. Also, my husband is disabled and moving is physically impossible. Can he make me leave if I ontinue to pay my rent? I am currently on a month to month lease.
