Tenants rights who are not on lease?
me my girlfriend and our two little ones moved in with a co worker.i guess her roomate moved out and she needed someone quick so we got the main room and paid 70% of rent we have been here six months,during the six months we kept asking her to put us on lease,she never did. know shes telling us she put in her 30 day notice shes movin out of town.she said shes givin us a week to pack and find another place to live or their locking us out.can she legally do that without giving us any type of 3 or 30 day notice since were not on lease.

also we have reciepts for the first couple of months proving we gave her money for rent.yesterday the roomates mom was here,when i was in my room putting my little girl to sleep she took all of our food,dishes and all the baby formula and threw it in the dumpster then after i was dumpster diving her mom locked the doors and told us we couldnt be their my 4 year old was still in the apartment thank god i had keys.we would just like at least aweek to pack even though we have no ware to go
                     
 




Landlord
You can force an eviction if you want to, but you really do not want that on your credit record, especially with kids to house. Most landlords will refuse to rent to you after you are evicted.

As far as the property owner is concerned they have no clue who you are. You are not their renter and have no rights to be there.

They will win the eviction in court, you have no chance to avoid it.

I think you can actually be evicted for not being on the lease. You shouldn't move into a place without first having a written and signed lease agreement.

I would talk with the landlord directly and see if you can rent the place. What she can or can't do legally isn't really an issue unless you can prove you paid her rent to stay there. If you can you would have a case. Anyways, the best you could do is to sue her and sounds like she doesn't have any money anyways. You should call it a lesson learned the hard way and go get your own place as quickly as possible.

If your there and not on the lease you have no rights. Your co-worker is not the owner, I'd talk to whomever owns the place and see if you can take over the rental.

Without a written lease you're in a tough situation but you should be treated as a month-to-month tenant which means you get 30 days notice. In any case why don't you approach the landlord yourself? Explain the situation and get a new lease drawn up for yourself, then you can stay.

She can move and not even tell you, leaving you stuck. Just approach the landlord and tell him you want to take the apartment now. You're an easy move-in, as far as the landlord is concerned. After he ran your credit/criminal history you'd just sign the lease. He wouldn't have any downtime.

Just as everyone else has said since you are not on the lease, legally you don't have any rights to that apartment. The co-worker can not change the locks with out the landlords approval, in which case the landlord usually does it, and they would need good reason. I would highly suggest getting over to the rental office and talking with the manager as soon as possible, to let them know of the situation and see if you and your girlfriend can take over the lease.


Trouble
She never had the right to allow you guys to move in. She could not add you to the lease, unless the landlord approved.

You, your girlfriend and little ones are unauthorized occupants.

The landlord cannot legally lock you out. The landlord can evict you hand have you removed from the premises.

If the lease holder moves out and you stay behind, the landlord can file an eviction against the lease holder (for allowing you to stay behind) and all of you. The court will evict all of you and if you do not leave voluntarily, the sheriff will physically remove you from the premises.

You should move out because of you do not, you will have an eviction on your record. The eviction will remain for several years and you will have a hard time finding a rental in the future.
