Forget the above, the correct answer is that it goes on the length of sentence. If the sentence is over 13 weeks the Housing Benefit entitlement stops from the first day of custody. Under 13 weeks they will continue to pay his rent. The same rule applies weather on remand or actually serving a sentence. That is the same whichever Local Authority in the country you are in.
Also, whatever the length of sentence he will also get a Council Tax exemption and not have to pay that.

Hello, I work for Housing Benefits and have done for 10 years, derbyandrew (abaove) is correct, housing benefit is paid for a maximum of 13 weeks, as for council tax there will be an exemption for an empty property |

Depends who your local council is, how long he's going to jail for, why he went to jail (if he was using the premises for something illegal that may effect the rights) and whether you want to keep him as a tenant. I'd call your council. |
